The court stated that the Charities Registration Board erred in declining the environmental campaigning organisation\u2019s application.<\/p>\n\n<p>In a summary of the judgement the High Court says: \u201cEnvironmental protection is a charitable purpose and Greenpeace NZ\u2019s advocacy advances the public benefit by gathering necessary support.\u201d<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The <a href=\"https:\/\/register.charities.govt.nz\/Charity\/CC58459\" data-type=\"link\" data-id=\"https:\/\/register.charities.govt.nz\/Charity\/CC58459\" target=\"_blank\" rel=\"noreferrer noopener\">Greenpeace Aotearoa constitution<\/a> can be found here on the Charities NZ website.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-charity-status-legal-fight\">Charity status legal fight <\/h2>\n\n<p>Greenpeace fought this case through the courts for over eight years, in the High Court, to the Court of Appeal, to the Supreme Court, back to the Charities Board and then to the High Court again.<\/p>\n\n<p>Greenpeace Aotearoa\u2019s executive director, Russel Norman <a href=\"https:\/\/www.greenpeace.org\/aotearoa\/press-release\/greenpeace-wins-high-court-charity-case-appeal\/\">said<\/a> the ruling was &#8220;a significant victory for Greenpeace and all of the environmental advocacy groups and campaigners who work ensure Earth\u2019s ability to sustain life in all its diversity.\u201d<\/p>\n\n<p>\u201cTwelve years after applying to be a charity, the High Court ruling in favour of Greenpeace is also a win for democracy in Aotearoa. Groups like Greenpeace, which challenge undue corporate influence and stand up for nature on behalf of future generations and the natural world, play a vital role in a healthy democracy. Protest and public good go hand in hand.<\/p>\n\n<p>\u201cThis case has essentially found that protecting nature is a public good, which I would have thought was self evident as we are part of nature and our very survival depends on a healthy nature world.<\/p>\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-history-aotearoa-stateless\/2021\/09\/380ddda3-gp0stqomp_web_size_with_credit_line.jpg\" alt=\"Greenpeace Aotearoa executive director Russel Norman swims in front of an oil exploration vessel with buoy and banner that reads \u201cRise Up \/ End Oil\u201d.\n\nGovernments generally don\u2019t like campaigning NGOs as they criticise Government activities. That\u2019s why Governments should not be involved in deciding whether an NGO gets charitable registration or not. As we saw in this case, the DIA again and again gave wrong advice, blocking Greenpeace\u2019s application.
