Humpback whales travel huge distances from the warm waters of the great barrier reef on the east coast of Australia to icy waters of the southern Ocean off Antarctic.<\/figcaption><\/figure>\n\n<p>Aotearoa New Zealand has already granted legal personhood to a river (<a href=\"https:\/\/www.whanganui.govt.nz\/About-Whanganui\/Our-District\/Te-Awa-Tupua-Whanganui-River-Settlement\" target=\"_blank\" rel=\"noreferrer noopener\">Te Awa Tupua Whanganui River<\/a>), land (<a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/2014\/0051\/latest\/DLM6183705.html\" target=\"_blank\" rel=\"noreferrer noopener\">Te Urewera<\/a>) and a mountain (<a href=\"https:\/\/www.theguardian.com\/world\/2017\/dec\/22\/new-zealand-gives-mount-taranaki-same-legal-rights-as-a-person\">Taranaki maunga<\/a>), but He Whakaputanga Moana differs from these earlier processes. It is based in customary law, or tikanga M\u0101ori, rather than Crown law.<\/p>\n\n<p>The declaration seeks to protect the rights of whales (tohor\u0101) to migrate freely and to use <a href=\"https:\/\/www.takai.nz\/find-resources\/articles\/matauranga-maori\/\">m\u0101tauranga M\u0101ori<\/a> alongside science for better protections. It also aims to set up a dedicated fund for whale conservation.<\/p>\n\n<p>But a core concept of legal personhood is the idea that the \u201cperson\u201d (in this case, whales) can sue to protect their rights.<\/p>\n\n<p>The declaration was signed by King Tuuheitia Pootatau Te Wherowhero VII of the Kiingitanga movement, Lisa Tumahai who chairs the <a href=\"https:\/\/thespinoff.co.nz\/atea\/13-12-2023\/maori-climate-startup-secures-multimillion-dollar-investment-at-cop28\" target=\"_blank\" rel=\"noreferrer noopener\">Hinemoana Halo Ocean<\/a> initiative, and the Cook Islands leader Kaumaiti Nui Travel Tou Ariki.<\/p>\n\n<p>It recognises traditional M\u0101ori and Pasifika ideas about the <a href=\"https:\/\/www.nytimes.com\/2024\/03\/29\/world\/australia\/whale-personhood-polynesia-maori.html\" target=\"_blank\" rel=\"noreferrer noopener\">importance of whales<\/a> as ancestral beings. King Tuuheitia described it as \u201ca woven cloak of protection for our taonga\u201d, noting the presence of whales \u201creflects the strength of our own mana\u201d.<\/p>\n\n<p>While He Whakaputanga Moana is not a pan-M\u0101ori declaration, mana is a shared core concept of tikanga M\u0101ori, representing authority and power.<\/p>\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<lite-youtube style=\"background-image: url('https:\/\/i.ytimg.com\/vi\/-NOtTvDrQ7w\/hqdefault.jpg');\" videoid=\"-NOtTvDrQ7w\" params=\"rel=0\"><\/lite-youtube>\n<\/div><figcaption class=\"wp-element-caption\">The Luxon Government&#8217;s intention to invite the return of oil exploration could mean more harm to whales from seismic blasting.<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-legal-personhood\">What is legal personhood?<\/h2>\n\n<p>Over the past few hundred years, legal personhood has been developed for companies as a way for individual shareholders to avoid liability. This means a company can go to court rather than its shareholders.<\/p>\n\n<p>In the past decade, Aotearoa New Zealand has led the way in developing legal personhood for things in nature into a <a href=\"https:\/\/www.theguardian.com\/world\/2019\/nov\/30\/saving-the-whanganui-can-personhood-rescue-a-river\" target=\"_blank\" rel=\"noreferrer noopener\">tool used as part of settlements<\/a> under Te Tiriti o Waitangi\/Treaty of Waitangi. It is important to note that these ideas have been recognised and implemented by the Crown in <a href=\"https:\/\/classic.austlii.edu.au\/au\/journals\/MelbJIL\/2019\/8.html\" target=\"_blank\" rel=\"noreferrer noopener\">partnership with M\u0101ori<\/a>.<\/p>\n\n<p>As part of the signing of the T\u016bhoe settlement in 2014, the former national park Te Urewera was granted legal personhood. In 2017, legal personhood for the Whanganui river was also part of a settlement. And last year, this idea was extended to Mount Taranaki. The <a href=\"https:\/\/www.beehive.govt.nz\/release\/government-honours-taranaki-maunga-deal\" target=\"_blank\" rel=\"noreferrer noopener\">Taranaki Maunga Collective Redress Bill<\/a> passed its first reading in parliament last week.<\/p>\n\n<p>These natural features are now not owned by people or the Crown, but by themselves.<\/p>\n\n<p>Legal personhood has been <a href=\"https:\/\/ir.canterbury.ac.nz\/server\/api\/core\/bitstreams\/cd0131bd-457f-47cb-939e-b6d1713e31a0\/content\">praised in New Zealand<\/a> and overseas by people interested in using it to protect the environment.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-tikanga-key-to-unlocking-legal-power\">Tikanga key to unlocking legal power<\/h2>\n\n<p>There is currently a shift in the legal system to <a href=\"https:\/\/www.lawcom.govt.nz\/assets\/Publications\/StudyPapers\/NZLC-SP24.pdf\">recognise tikanga as a key source of law<\/a> alongside statute and common law (the kind of customary law New Zealand inherited from England).<\/p>\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2021\/08\/f608e1e7-gp1svnfa_medium_res-1024x683.jpg\" alt=\"\" class=\"wp-image-49234\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2021\/08\/f608e1e7-gp1svnfa_medium_res-1024x683.jpg 1024w, https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2021\/08\/f608e1e7-gp1svnfa_medium_res-600x400.jpg 600w, https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2021\/08\/f608e1e7-gp1svnfa_medium_res-768x512.jpg 768w, https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2021\/08\/f608e1e7-gp1svnfa_medium_res-510x340.jpg 510w, https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2021\/08\/f608e1e7-gp1svnfa_medium_res.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">Humpback whale calf, approximately 1 week old, shy but curious enough to approach the lens. This week old calf is still growing into its floppy skin.<\/figcaption><\/figure>\n\n<p>In the recent case of <a href=\"https:\/\/www.courtsofnz.govt.nz\/assets\/cases\/2022\/2022-NZSC-114.pdf\">Ellis v R<\/a>, the Supreme Court recognised and applied ideas about mana. In deciding to overturn the conviction of Peter Ellis posthumously, the court held that Mr Ellis\u2019 mana was affected by the convictions, even after his death.<\/p>\n\n<p>He Whakaputanga Moana is based on customary concepts like mana rather than being a Crown-drafted piece of law. It is likely it could be recognised by the courts as part of the growing wave of tikanga jurisprudence.<\/p>\n\n<p>Marine mammals in New Zealand\u2019s territorial waters are protected absolutely by the <a href=\"https:\/\/www.legislation.govt.nz\/act\/public\/1978\/0080\/latest\/DLM25111.html\" target=\"_blank\" rel=\"noreferrer noopener\">Marine Mammals Protection Act 1978<\/a> (as has recently been highlighted when the <a href=\"https:\/\/www.greenpeace.org\/aotearoa\/story\/russell-coutts-hectors-dolphin-sailgp-war-on-nature\/\">Sail GP regatta was held in a marine sanctuary<\/a> and races were delayed because dolphins were present).<\/p>\n\n<p>But He Whakaputanga Moana recognises legal personhood above and beyond that legislation.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-whales-in-court\">Whales in court<\/h2>\n\n<p>So what if whales went to court? The defendants said the claim could not s\ucceed and applied for a \u201cstrike out\u201d, but the Supreme Court has allowed it go to trial.<\/p>\n\n<p>Among other findings, the court found the litigation should proceed, as it might involve ideas of tikanga and tikanga-based loss that should be tested at trial.
