{"id":63407,"date":"2024-04-26T07:06:31","date_gmt":"2024-04-25T19:06:31","guid":{"rendered":"https:\/\/www.greenpeace.org\/aotearoa\/?p=63407"},"modified":"2025-05-20T13:29:57","modified_gmt":"2025-05-20T01:29:57","slug":"climate-change-human-rights-how-landmark-legal-victory-europe-affect-nz","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/aotearoa\/story\/climate-change-human-rights-how-landmark-legal-victory-europe-affect-nz\/","title":{"rendered":"Climate change and human rights: how a landmark legal victory in Europe could affect\u00a0NZ"},"content":{"rendered":"\n<p>A seven-year campaign by a group of over 2,000 Swiss women \u2013 average age 73 \u2013 recently ended with a <a href=\"https:\/\/hudoc.echr.coe.int\/eng#%7B%22itemid%22:%5B%22001-233206%22%5D%7D\">European Court of Human Rights decision<\/a> variously described as a \u201c<a href=\"https:\/\/www.reuters.com\/sustainability\/climate-activists-seek-breakthrough-human-rights-court-ruling-against-european-2024-04-09\/\">landmark<\/a>\u201d, \u201c<a href=\"https:\/\/www.ejiltalk.org\/a-quick-take-on-the-european-courts-climate-change-judgments\/\">monumental<\/a>\u201d, and \u201c<a href=\"https:\/\/www.rnz.co.nz\/news\/top\/513879\/european-court-rules-human-rights-violated-by-climate-inaction\">the biggest victory possible<\/a>\u201d.<\/p>\n\n<p>Swiss Elders for Climate Protection \u2013 <em>KlimaSeniorinnen Schweiz<\/em> \u2013 had challenged the Swiss government\u2019s emissions reductions strategy as \u201cwholly inadequate\u201d. The court largely agreed. The decision has made waves in Europe. Might its ripples reach New Zealand\u2019s shores?<\/p>\n\n<p>A 2023 <a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/publication\/global-trends-in-climate-change-litigation-2023-snapshot\/\">survey of global climate litigation<\/a> counted over 2,300 cases, two thirds filed since 2015. Youth litigants have been especially active, including <a href=\"https:\/\/climatecasechart.com\/non-us-case\/raj-seppings-v-ley\/\">Sharma v Minister for the Environment<\/a> in Australia, and <a href=\"https:\/\/climatecasechart.com\/non-us-case\/thomson-v-minister-for-climate-change-issues\/\">Thomson v Minister for Climate Change<\/a> in New Zealand.<\/p>\n\n<p>Youth perspectives have resonance in climate cases, given the long-term implications of climate change and impacts of future emissions reductions policies. Cases such as the one taken by <em>KlimaSeniorinnen<\/em> take a different tack, pointing to the vulnerability of older people.<\/p>\n\n<p>One applicant had been hospitalised after collapsing during a heatwave. She died during the court proceedings. Others had respiratory or cardiovascular problems exacerbated by rising temperatures. Their evidence aligns with <a href=\"https:\/\/www.ehinz.ac.nz\/indicators\/climate-change\/vulnerability\/\">New Zealand research<\/a> on higher risks from climate change for older people.<\/p>\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/images.theconversation.com\/files\/589676\/original\/file-20240423-18-iaqsme.jpg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=754&amp;fit=clip\" alt=\"Two judges at the bench of the European Court of Human Rights\"\/><figcaption class=\"wp-element-caption\">President of the European Court of Human Rights Siofra O&#8217;Leary leads the hearing involving the Swiss case against government climate action. Getty Images<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\" id=\"h-emissions-policy-on-trial\">Emissions policy on trial<\/h2>\n\n<p>The Swiss women argued, first in the Swiss domestic courts and then in the European Court of Human Rights, that their government\u2019s failure to implement adequate emissions reductions meant it had breached various human rights obligations, including the rights to life, and <a href=\"https:\/\/www.equalityhumanrights.com\/human-rights\/human-rights-act\/article-8-respect-your-private-and-family-life\">private and family life<\/a>, under the European Convention on Human Rights (ECHR).<\/p>\n\n<p>In a 260-page ruling, the court agreed that the right to private life had been breached. But it said it didn\u2019t need to reach a conclusion on the right to life claim. Having declared Switzerland in breach of its ECHR obligations, the court left it to the government to comply with the convention.<\/p>\n\n<p>Like New Zealand, Switzerland has made international commitments to emissions reductions under the Paris Climate Agreement. However, the Swiss government struggled to pass legislation reflecting the accepted target reductions.<\/p>\n\n<p>A national referendum in 2021 rejected a proposed CO\u2082 Act intended to translate the country\u2019s Paris commitments into domestic law. It was not until June 2023 that a second referendum affirmed a replacement Climate Act. But by the time the European Court of Human Rights issued its decision, the Swiss Climate Act had not yet come into force.<\/p>\n\n<p>The independent <a href=\"https:\/\/climateactiontracker.org\/countries\/switzerland\/policies-action\/\">Climate Action Tracker<\/a> has called Switzerland\u2019s strategy \u201cinsufficient\u201d. So it was unsurprising the court declared it in breach of its human rights obligations. The decision has obvious ramifications for the Swiss Confederation and other Council of Europe members. But could it also have implications closer to home?<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-implications-for-nz-courts\">Implications for NZ courts<\/h2>\n\n<p>New Zealand is not bound by decisions of the European Court of Human Rights. But New Zealand courts regularly consider cases from overseas when determining claims.<\/p>\n\n<p>Local activists, lawyers and judges will be poring over the judgement, which addresses a number of contested issues in existing and potential future cases in this jurisdiction.<\/p>\n\n<p>First, New Zealand has ratified other international human rights instruments, including the United Nations International Covenant on Civil and Political Rights (ICCPR). New Zealand is also a party to the ICCPR\u2019s <a href=\"https:\/\/www.ohchr.org\/en\/instruments-mechanisms\/instruments\/optional-protocol-international-covenant-civil-and-political\">Optional Protocol<\/a>. This opens it up to compliance rulings by the UN Human Rights Committee, as occurred in the 2020 <a href=\"https:\/\/climatecasechart.com\/non-us-case\/un-human-rights-committee-views-adopted-on-teitiota-communication\/\">Teitoita v New Zealand<\/a> climate-related case.<\/p>\n\n<p>The New Zealand Bill of Rights Act imposes human rights obligations on public authorities. In a <a href=\"https:\/\/climatecasechart.com\/non-us-case\/smith-v-attorney-general\/\">related claim<\/a> to his climate case against <a href=\"https:\/\/theconversation.com\/one-of-nzs-most-contentious-climate-cases-is-moving-forward-and-the-world-is-watching-223177\">Fonterra and others<\/a>, M\u0101ori elder Mike Smith has sued the New Zealand government, claiming (among other things) that its inadequate emissions reductions framework breaches the rights to life and to practise culture under the Bill of Rights.<\/p>\n\n<p>The case is currently at the Court of Appeal. If it goes to the Supreme Court or UN Human Rights Committee, the European Court of Human Rights decision in the <em>KlimaSeniorinnen<\/em> case could well feature prominently.<\/p>\n\n<p>But <em>KlimaSeniorinnen<\/em>\u2018s relevance is not limited to human rights claims. An important aspect of the European judgement was a meticulous analysis of the factual and scientific context for the women\u2019s claim.<\/p>\n\n<p>The court comprehensively assessed the latest climate science, endorsing the need for \u201cdeep, rapid and sustained reductions in greenhouse gas emissions\u201d. That part of the decision offers something of a model for New Zealand courts in all sorts of climate cases.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-legal-issues-without-borders\">Legal issues without borders<\/h2>\n\n<p>The case also addresses a perennial question in climate cases in New Zealand and elsewhere: what is the proper role and function of the courts in assessing government responses to climate change?<\/p>\n\n<p>Arguments about judicial competence to review policy-laden regulatory responses were (and will be) central to these ongoing cases, including <a href=\"https:\/\/www.rnz.co.nz\/news\/national\/503193\/lawyers-vs-climate-change-commission-appeal-court-mulling-challenge-to-the-pace-of-carbon-cuts-after-heated-hearing\">Lawyers for Climate Action v Climate Change Commission<\/a>, now awaiting a decision by the New Zealand Court of Appeal.<\/p>\n\n<p>In the <em>KlimaSeniorinnen<\/em> case, the European Court of Human Rights readily acknowledged limits to judicial involvement in climate policy. But it ruled \u201cthe Court\u2019s competence in the context of climate change litigation cannot, as a matter of principle, be excluded\u201d.<\/p>\n\n<p>We can expect its thoughtful approach on this issue to be carefully considered in New Zealand cases.<\/p>\n\n<p>The Swiss case was decided under a particular legal, constitutional and institutional setting, in many respects different to New Zealand\u2019s.
