In recent years, these Strategic Lawsuits Against Public Participation (SLAPP) have been wielded by corporations attempting to suppress free speech and limit people power.<\/p>\n\n<p>Greenpeace USA and Greenpeace International are scheduled to go to trial in North Dakota, USA. They are being sued by Energy Transfer \u2013 a US-based fossil fuel company that is responsible for the Dakota Access Pipeline \u2013 for nearly US $300 million related to the Indigenous-led 2016 protests at Standing Rock. Not only does this SLAPP attempt to rewrite the history of this movement led by the Standing Rock Sioux, but a loss at trial could prove destructive to Greenpeace in the US and have widespread impacts on the climate justice movement all around the world.<\/p>\n\n<p>Energy Transfer\u2019s SLAPP against Greenpeace is a crucial test of this dangerous legal tactic that, if successful, could be widely applied against peaceful protesters and, indeed, anyone who speaks out or criticises a deep-pocketed corporation. Let\u2019s take a deeper look at the backstory of this lawsuit, the threat posed by SLAPPs, and why this case matters for all of us.<\/p>\n\n<h2 class=\"wp-block-heading\">The real story of Standing Rock<\/h2>\n\n<p>In 2016, the entire world was riveted by the resistance led by the Standing Rock Sioux Tribe against the\u00a0<a href=\"https:\/\/apnews.com\/general-news-1a00f95c83594dac931796a332540750\" target=\"_blank\" rel=\"noreferrer noopener\">Dakota Access Pipeline<\/a>\u00a0(DAPL). Tens of thousands of people, including\u00a0<a href=\"https:\/\/www.theguardian.com\/us-news\/2016\/nov\/30\/standing-rock-indigenous-people-history-north-dakota-access-pipeline-protest\" target=\"_blank\" rel=\"noreferrer noopener\">members of more than 300 tribal nations<\/a>, travelled to protect the water and to show solidarity with Standing Rock. In October 2016, United Nations representatives\u00a0<a href=\"https:\/\/www.un.org\/esa\/socdev\/unpfii\/documents\/2016\/Docs-updates\/Report-ChiefEdwardJohn-DAPL2016.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">visited Standing Rock and voiced concerns<\/a>\u00a0about Indigenous sovereignty.<\/p>\n\n<p>The\u00a0<a href=\"https:\/\/apnews.com\/general-news-1a00f95c83594dac931796a332540750\" target=\"_blank\" rel=\"noreferrer noopener\">Dakota Access Pipeline<\/a>\u00a0(DAPL), proposed by Energy Transfer and its partners in 2014, would have carried crude oil from North Dakota\u2019s Bakken oil field to Illinois and then down to the US Gulf Coast. DAPL was part of the fracking boom that began in the region in 2008 that also spurred the construction of oil export terminals and other infrastructure, all of which lock us into more fossil fuel dependence,\u00a0<a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S2214629623001640\" target=\"_blank\" rel=\"noreferrer noopener\">harm nearby communities<\/a>, and\u00a0<a href=\"https:\/\/www.greenpeace.org\/usa\/reports\/fossil-fuel-phaseout\/\" target=\"_blank\" rel=\"noreferrer noopener\">undermine the slow progress we are making on meeting the Paris Agreement goals<\/a>.<\/p>\n\n<p>From the very start, members of the Standing Rock Sioux Tribe, along with other Sioux Nations, opposed the pipeline. Tribal chairman Dave Archambault&nbsp;<a href=\"https:\/\/www.nytimes.com\/2016\/08\/25\/opinion\/taking-a-stand-at-standing-rock.html\" target=\"_blank\" rel=\"noreferrer noopener\">put the pipeline in historical perspective<\/a>: \u201cWhether it\u2019s gold from the Black Hills or hydropower from the Missouri or oil pipelines that threaten our ancestral inheritance, the tribes have always paid the price for America\u2019s prosperity.\u201d<\/p>\n\n<p>Starting in April 2016,&nbsp;<a href=\"https:\/\/www.nytimes.com\/2017\/01\/31\/magazine\/the-youth-group-that-launched-a-movement-at-standing-rock.html\" target=\"_blank\" rel=\"noreferrer noopener\">tribal members set up prayer encampments<\/a>&nbsp;near the proposed water crossing, and young Water Protectors organized a 500-mile relay run to deliver a letter to the US Army Corps of Engineers. In July 2016,&nbsp;<a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/315420120complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Standing Rock filed a lawsuit<\/a>&nbsp;against the US Army Corps to block approval of the pipeline.&nbsp; As the construction of the \u201cBlack Snake\u201d drew closer and closer to the river in summer and fall of 2016, the growing anti-pipeline protests captured national and then&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2016\/apr\/01\/native-american-north-dakota-oil-pipeline-protest\" target=\"_blank\" rel=\"noreferrer noopener\">global attention<\/a>.&nbsp;<\/p>\n\n<p>Then in November 2016, Donald Trump was elected US president. While the preceding Barack Obama administration had rejected Energy Transfer\u2019s land access request for the pipeline in December 2016, one of Trump\u2019s&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/DCPD-201700067\/pdf\/DCPD-201700067.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">first acts was to approve the pipeline<\/a>. Energy Transfer CEO Kelcy Warren had recently&nbsp;<a href=\"https:\/\/insideclimatenews.org\/news\/19042017\/fossil-fuels-oil-coal-gas-exxon-chevron-bp-donald-trump-inauguration-donations\/\" target=\"_blank\" rel=\"noreferrer noopener\">donated US $250,000 to his Inauguration<\/a>, and later&nbsp;<a href=\"https:\/\/www.theguardian.com\/us-news\/2020\/aug\/09\/big-oil-trump-campaign-donations-fossil-fuel-industry\" target=\"_blank\" rel=\"noreferrer noopener\">gave US $10 million to Trump\u2019s 2020 re-election<\/a>&nbsp;effort. Construction was completed and the pipeline&nbsp;<a href=\"https:\/\/www.pbs.org\/newshour\/nation\/dakota-access-pipeline-operation-months-resistance\">went into operation in June 2017<\/a>.<\/p>\n\n<p>Although oil was flowing, the Standing Rock Sioux Tribe was not done fighting. Their lawsuit continued on, and in 2020 a US&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/local\/public-safety\/federal-judge-orders-environmental-review-of-dakota-access-pipeline\/2017\/06\/14\/6de94c98-5152-11e7-b064-828ba60fbb98_story.html\">federal judge ordered the Army Corps<\/a>&nbsp;to conduct a full Environmental Impact Statement on the pipeline crossing. However, an order to&nbsp;<a href=\"https:\/\/apnews.com\/general-news-731d4e549040ae37c2884a1d0960bcf3\">shut down the pipeline was not upheld<\/a>. Today, the Standing Rock Sioux Tribe is still demanding that \u201c<a href=\"https:\/\/standingrock.org\/dapl-eis\/\">the Corps shut the pipeline down and conduct a proper environmental review, not one prepared by the fossil fuel industry<\/a>.\u201d<\/p>\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/08\/8a8edf6b-gp0stq9vd_medium_res-1024x683.jpg\" alt=\"Protest at Standing Rock Dakota Access Pipeline in the US, 2016.  \u00a9 Richard Bluecloud Castaneda \/ Greenpeace\u00a9 Richard Bluecloud Castaneda \/ Greenpeace\" class=\"wp-image-18080\" title=\"Protest at Standing Rock Dakota Access Pipeline in the US, 2016.  \u00a9 Richard Bluecloud Castaneda \/ Greenpeace\u00a9 Richard Bluecloud Castaneda \/ Greenpeace\"\/><figcaption class=\"wp-element-caption\">Protest at Standing Rock Dakota Access Pipeline in the US, 2016. \u00a9 Richard Bluecloud Castaneda \/ Greenpeace<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\">Energy Transfer wants revenge, not justice<\/h2>\n\n<p>The fight against DAPL is still ongoing, but the 2016 and 2017 Standing Rock protests were powerful displays of resistance to corporate power that clearly rattled Big Oil. Since 2016, broad fossil fuel&nbsp;<a href=\"https:\/\/www.greenpeace.org\/usa\/wp-content\/uploads\/2023\/10\/Dollars-vs-Democracy-Report-2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">anti-protest laws have been enacted in 18 US states<\/a>. All around the world, close relationships between fossil fuel entities and government officials have s\ucceeded in many efforts that shrink civic space and heighten the consequences for engaging in peaceful protest.&nbsp;<\/p>\n\n<p>In the case of Energy Transfer, they turned to the courts.<\/p>\n\n<p>Energy Tranfer\u2019s initial 2017 lawsuit \u2014 a truly wild piece of creative writing that, among other things, claimed that Greenpeace and not the Standing Rock Sioux Tribe or Indigenous water protectors was the organizer behind the protests \u2014 was dismissed by a US federal judge in 2019. But Energy Transfer refiled the suit in North Dakota state court with many of the same bad-faith arguments.&nbsp;<\/p>\n\n<p>In a pair of 2017 media interviews, Energy Transfer CEO Kelcy Warren talked about the rationale for the first lawsuit. In one interview Warren&nbsp;<a href=\"https:\/\/www.valleynewslive.com\/content\/misc\/Energy-Transfer-Partners-CEO-Kelcy-Warren-says-DAPL-was-about-a-money-raise-442409553.html\" target=\"_blank\" rel=\"noreferrer noopener\">stated<\/a>&nbsp;that he was \u201cabsolutely\u201d trying to \u201ccease funding\u201d for Greenpeace, and in another&nbsp;<a href=\"https:\/\/www.cnbc.com\/video\/2017\/08\/25\/we-were-greatly-harmed-lost-millions-of-dollars-energy-transfer-partners-ceo.html\" target=\"_blank\" rel=\"noreferrer noopener\">claimed<\/a>&nbsp;that his \u201cprimary objective\u201d was not recovering monetary damages but rather to \u201csend a message, you can\u2019t do this, this is unlawful and it\u2019s not going to be tolerated in the United States.\u201d<\/p>\n\n<p>What\u2019s more, this lawsuit may have been part of a coordinated effort to go after Greenpeace in particular. The same law firm that filed the ET suit had the year before filed a similar SLAPP suit against Greenpeace on behalf of Resolute Forest Products. Greenpeace finally&nbsp;<a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/59416\/greenpeace-defeats-slapp-lawsuit-free-speech-victory\/\" target=\"_blank\" rel=\"noreferrer noopener\">won that lawsuit outright in 2023<\/a>; the case was resolved in 2024 after nearly a decade of litigation. The firm in question \u2013 Kasowitz Benson Torres, founded by one of Trump\u2019s personal attorneys \u2013 told Bloomberg that they were \u201c<a href=\"https:\/\/web.archive.org\/web\/20170828202132\/https:\/\/www.bloomberg.com\/news\/articles\/2017-08-28\/how-a-corporate-assault-on-greenpeace-is-spreading\" target=\"_blank\" rel=\"noreferrer noopener\">in touch with other companies<\/a>\u201d that were thinking of suing Greenpeace.<\/p>\n\n<h2 class=\"wp-block-heading\">SLAPPs vs. People Power<\/h2>\n\n<p>Like all SLAPPs, Energy Transer\u2019s current, meritless US $300 million lawsuit against Greenpeace is an attack on two key elements of public advocacy: free speech and peaceful protest. These bullying lawsuits were brought or initiated by business actors against organisations or individuals and groups related to their defence of human rights or the environment.&nbsp;<\/p>\n\n<p>For more than 50 years, Greenpeace has taken action in defence of people and the planet.
