After a recent barrage of such bullying lawsuits from Big Oil companies,&nbsp;<a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/72706\/greenpeace-international-files-lawsuit-against-energy-transfer-in-first-use-of-eu-anti-slapp-directive\/\">GPI has now filed a lawsuit in Dutch court against the worst offender, Energy Transfer<\/a>. The US-based fossil fuel pipeline company is waging one of the world\u2019s most&nbsp;<a href=\"https:\/\/www.greenpeace.org\/international\/story\/67866\/energy-transfer-slapp-lawsuit-vs-greenpeace-people-power\/?_thumbnail_id=59423\">brazen SLAPPs<\/a>&nbsp;\u2014 and it\u2019s time to demonstrate this practice doesn\u2019t pay.&nbsp;<\/p>\n\n<p><a href=\"https:\/\/www.greenpeace.org\/international\/story\/59478\/slapp-lawsuits-corporate-bullies-vs-free-speech\/\">Strategic Lawsuits Against Public Participation<\/a>&nbsp;(known as SLAPPs) are a weapon&nbsp;<a href=\"https:\/\/earthrights.org\/publication\/the-fossil-fuel-industrys-use-of-slapps-and-judicial-harassment-in-the-united-states\/\">widely used by fossil fuel companies<\/a>&nbsp;against environmental activists, journalists, and Indigenous Peoples. The EU\u2019s anti-SLAPP&nbsp;<a href=\"https:\/\/www.the-case.eu\/latest\/the-anti-slapp-directive-creates-a-promising-minimum-standard-for-member-states\/\">Directive was adopted in March 2024<\/a>&nbsp;after a&nbsp;<a href=\"https:\/\/www.the-case.eu\/\">strong civil society coalition<\/a>&nbsp;pers\uaded the EU to act.<\/p>\n\n<p>Greenpeace International and the Greenpeace entities in the US are currently&nbsp;<a href=\"https:\/\/www.greenpeace.org\/international\/story\/67866\/energy-transfer-slapp-lawsuit-vs-greenpeace-people-power\/?_thumbnail_id=59423\">defending a meritless SLAPP lawsuit for nearly US$ 300 million<\/a>&nbsp;in North Dakota filed by Energy Transfer (ET). Within months after its adoption, the&nbsp;<a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2024\/03\/19\/anti-slapp-final-green-light-for-eu-law-protecting-journalists-and-human-rights-defenders\/\">new EU anti-SLAPP Directive<\/a>&nbsp;was already factoring into GPI\u2019s fight against ET: GPI, which is based in the Netherlands,&nbsp;<a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/68484\/greenpeace-international-challenges-energy-transfer-in-first-use-of-eu-anti-slapp-directive\/\">sent a Notice of Liability<\/a>&nbsp;in July 2024 informing ET of its intention to bring a lawsuit against the company in a Dutch court to recover all damage and costs it has suffered as a result of the SLAPP suit, unless ET withdraws its case against Greenpeace International and accepts responsibility. Energy Transfer refused to do so.<\/p>\n\n<p>GPI\u2019s legal action sends a message to ET and overreaching corporate polluters that civil society will not be silenced, and is ready to push back against SLAPPs.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-backstory-of-energy-transfer-s-baseless-slapp-lawsuit\">The backstory of Energy Transfer\u2019s baseless SLAPP lawsuit<\/h2>\n\n<p>Energy Transfer LP is a&nbsp;<a href=\"https:\/\/www.energytransfer.com\/operations\/\">company that runs one of the largest fossil fuel pipeline networks and associated energy infrastructure in the US<\/a>. Its founder and Executive Chairman is Texan billionaire Kelcy Warren<a href=\"https:\/\/www.usatoday.com\/story\/news\/investigations\/2024\/07\/06\/biggest-joe-biden-donald-trump-rfk-donors\/74283755007\/\">, a key financial supporter of Donald Trump<\/a>. In&nbsp;<a href=\"https:\/\/www.greenpeace.org\/international\/story\/67866\/energy-transfer-slapp-lawsuit-vs-greenpeace-people-power\/?_thumbnail_id=59423\">April 2016, tribal members set up prayer encampments to voice objections to the route ET had chosen for its Dakota Access Pipeline<\/a>&nbsp;(DAPL), and organised powerful displays of resistance to corporate power that clearly rattled Big Oil.&nbsp;<\/p>\n\n<p>ET has filed back-to-back SLAPPs against the Greenpeace entities in an attempt to rewrite the history of this Indigenous-led movement. In its first case, in 2017, ET alleged the Greenpeace defendants form part of a criminal enterprise that orchestrated the Indigenous-led movement as a way to raise funds. When this bogus theory was rightly thrown out by the federal court, ET promptly filed a new suit in a North Dakota State court, making wide-ranging (and similar) allegations. But the only concrete thing ET can actually point to GPI having done is co-signing, together with over 500 other organisations, an open letter expressing concern about DAPL towards banks financing the pipeline. From the outset, this has been an attempt by ET to bury nonprofits and activists in legal fees, make them go bankrupt, and ultimately silence dissent.<\/p>\n\n<p>The jury trial is set to open on February 24 in North Dakota, a jurisdiction that lacks anti-SLAPP legislation.<\/p>\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/06\/GP0STQL2S-1024x683.jpg\" alt=\"Thousands Rally in Support of Native Nation in Washington D.C. \u00a9 Amanda J. Mason \/ Greenpeace<\/figcaption><\/figure>\n\n<h2 class=\"wp-block-heading\" id=\"h-the-eu-pushes-back-against-slapps\">The EU pushes back against SLAPPs<\/h2>\n\n<p>The EU\u2019s adoption, in March 2024, of a Directive to combat SLAPPs, like the ET suit, gives EU-based victims of SLAPP lawsuits a mechanism to fight back. In particular, Chapter V of the Directive protects organisations based in the EU against SLAPPs from outside the EU, and entitles them to claim compensation.&nbsp;<\/p>\n\n<p>The EU\u2019s anti-SLAPP Directive was adopted amid widespread misuse of legal systems to target journalists, activists, whistleblowers and other watchdogs.&nbsp; A&nbsp;<a href=\"https:\/\/www.the-case.eu\/latest\/number-of-slapps-in-europe-continues-to-rise\/\">report by the Coalition Against SLAPPs in Europe (CASE)<\/a>&nbsp;documented 1,049 SLAPP suits in Europe in
