{"id":71777,"date":"2025-07-01T09:26:43","date_gmt":"2025-06-30T21:26:43","guid":{"rendered":"https:\/\/www.greenpeace.org\/aotearoa\/?p=71777"},"modified":"2025-07-01T09:30:56","modified_gmt":"2025-06-30T21:30:56","slug":"official-documents-reveal-widespread-opposition-to-seymours-regulatory-standards-bill","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/aotearoa\/press-release\/official-documents-reveal-widespread-opposition-to-seymours-regulatory-standards-bill\/","title":{"rendered":"Official documents reveal widespread opposition to Seymour\u2019s Regulatory Standards Bill"},"content":{"rendered":"\n<p>Documents released to Greenpeace Aotearoa under the Official Information Act reveal that both the Ministry for the Environment (MfE) and Treasury have joined the growing list of bodies issuing strong warnings against the Regulatory Standards Bill.<\/p>\n\n<p>In <a href=\"https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2025\/06\/b8f823e6-brf-5985-departmental-commentary-on-the-regulatory-standards-bill.pdf\">a scathing assessment<\/a> dated 20 March, the Ministry for the Environment described the Bill as \u201cdeeply problematic\u201d and warned that it \u201cconflicts with the fundamental principles of the environmental management system\u201d and \u201cposes risks to the health, safety, economic, social, and environmental interests of current and future New Zealanders.\u201d<\/p>\n\n<p>Greenpeace is calling on the Prime Minister to withdraw his support for the Bill.<\/p>\n\n<p>\u201cThis damning official advice confirms what Greenpeace have been warning all along: this Bill represents an<strong> <\/strong>unprecedented threat to our environment and to the Government\u2019s ability to respond to the climate crisis,\u201d said Greenpeace spokesperson Gen Toop.<\/p>\n\n<p>The Treasury, <a href=\"https:\/\/www.greenpeace.org\/static\/planet4-aotearoa-stateless\/2025\/06\/f5eddc5e-treasury-advice-on-rsb.pdf\">in a separate briefing<\/a> dated 28 March 2025, warned the Bill \u201ccould impose costs on agencies exceeding the potential economic and societal benefit\u201d and \u201cmay also have a chilling effect on the development and retention of beneficial regulation.\u201d<\/p>\n\n<p>\u201cWhat we\u2019re seeing here is overwhelming opposition to the Bill from the very institutions tasked with upholding good lawmaking, public safety, and environmental stewardship. That\u2019s because the real intent behind David Seymour\u2019s Regulatory Standards bill is to tie the hands of future Governments and impose the ACT party\u2019s far-right neoliberal principles on our democracy.\u201d&nbsp;<\/p>\n\n<p>\u201cThis is a dangerous, undemocratic piece of legislation being pushed through via a backroom coalition deal,\u201d said Toop. \u201cIt\u2019s time for the Prime Minister to show some leadership and scrap it.\u201d<\/p>\n\n<p>MfE and Treasury were both particularly critical of the Bill\u2019s proposed expectation that the government compensate corporations for regulations that affect their property. MfE said it risks \u201creversing the \u2018polluter pays\u2019 principle\u201d, and Treasury stated it \u201cgoes further than conventional policy in this area\u201d warning it could lead to delays and increased costs on infrastructure projects.<\/p>\n\n<p>\u201cIt\u2019s a simple principle: polluters should pay &#8211; not be paid by the public,\u201d said Toop. \u201cBut this Bill would flip that on its head, allowing corporations to expect taxpayer compensation for basic environmental and human health protections,\u201d says Toop.<\/p>\n\n<p>\u201cIt is the role of the Government to govern for the collective well-being of the people it serves, and that includes protecting the environment and the climate on which we all depend. This Bill upends that and tries to make our Government serve corporate interests instead.\u201d<\/p>\n\n<p>Treasury and MfE are the latest to join a growing list of governmental agencies issuing warnings over the bill. The Ministry of Justice has<a href=\"https:\/\/www.regulation.govt.nz\/assets\/Publication-Documents\/Information-Release-Policy-Approvals-for-Progressing-a-Regulatory-Standards-Bill-May-2025_v4.pdf\"> warned<\/a> it\u2019s not in line with the NZ Bill of Rights Act and \u201cfails to recognise the constitutional significance of the Treaty of Waitangi.\u201d <\/p>\n\n<p>While Parliament\u2019s legislative watchdog has <a href=\"https:\/\/newsroom.co.nz\/2025\/06\/04\/parliaments-law-making-watchdog-warns-against-regulatory-standards-bill\/\">cautioned that the Bill <\/a>could lead to \u201csignificant unintended consequences,\u201dWhaikaha, the Ministry of Disabled People, has<a href=\"http:\/\/thepost.co.nz\/politics\/360735222\/seymours-red-tape-bill-under-fire-disability-ministry\"> raised concerns <\/a>that it may breach international obligations and exclude disabled people from decision-making, and the Waitangi Tribunal called for an <a href=\"https:\/\/www.stuff.co.nz\/nz-news\/360691267\/waitangi-tribunal-calls-halt-regulatory-standards-bill-finds-crown-breached-treaty-principles\">immediate halt<\/a> to the bill after its urgent
