Resolution of 75 Environmental and Conservation NGOs Regarding the Draft Bill of Transparency for Organisations Receiving Foreign Support

The goal of our organisations is to ensure, as enshrined in the Hungarian Constitution, the preservation of natural resources and the right of citizens to a healthy environment. The Hungarian population regards conservation and environmental protection to be of paramount importance and as activities that should be free of party politics. We strive for constructive co-operation with all societal actors, including the current government in question. Our active participation in programmes related to the implementation of international environmental conventions and effective action against cross-border environmental pollution and environmental degradation are closely related to achieving our goals to work in the public’s interest.

Our most important concerns about the draft bill are the following:

• We consider the proposed legislation to be superfluous. Current regulations already provide a suitable legal framework for the transparent functioning of NGOs. Our organisations’ sources of income, the amount of support, and how those funds have been spent have always been open to the public.
• We reject the stigma implied by the bill. Foreign resources help to better address local, regional and international environmental issues. The use of these resources is fully verifiable and transparent. Our activities are conducted openly, without any outside influence, and are carried out in the interests of the Hungarian people.
• We regard the bill to be discriminatory. Without justification, the proposal excludes certain types of organisations from the scope of the regulation. For example, the law would not apply to the business sector or to government-sponsored organisations.
• The bill may violate the right to privacy, and is technically impracticable. On the basis of the proposal, once the annual limit has been reached, even minor private donations coming through online fundraising platforms will have to be displayed in detail in the database. However, such statutory information is not typically available for donations of this kind.
• The law runs contrary to the goals of building public trust in the National Sustainable Development Strategy, Hungary's dedication to the development of the civil sector, as well as its European commitments.
• The bill may weaken domestic public interest in conservation and environmental protection.
• We object to the fact that the necessity of such legislation has been justified by drawing a false and generalised relationship between all NGOs using international resources and terrorism and money laundering. In fact, NGOs are exerting themselves to make our country a cleaner, more peaceful and more liveable place.

We expect the authors of the bill to withdraw the current version. We, the green NGOs, in the interest of future generations, are committed to supporting an economy and society that function in a transparent manner. However, we consider the instruments set out in the existing draft to be unnecessary, disproportionate, stigmatising and discriminatory. If accepted in this form, the consequences would be to further complicate the efficiency of our domestic environmental and conservation work with new administrative burdens.

We are ready to participate in a true social debate on the Government’s proposal, one that seeks to ensure the transparent operation of all social and economic actors in a proportionate and reasonable way.
