One particular tool stands out: strategic lawsuits against public participation (SLAPPs), which are meant to tie critics up in expensive, distracting and time-consuming court battles. But there\u2019s a worrying gap in the way Canadian courts interpret\nlawsuits brought by powerful groups against their critics. Right now, there isn\u2019t\na good enough legal test to determine whether or not a case is SLAPP. This is a\nproblem because it makes it difficult to dismiss abusive lawsuits right away. <\/p>\n\n<p>This leaves people speaking truth to power vulnerable to retaliatory attacks. Every one of us \u2014 from Indigenous land and water protectors to civil society groups, environmental activists, whistleblowers, journalists, survivors of sexual and gender-based violence and beyond \u2014 deserve adequate protection before the law.<\/p>\n\n<p>But there\u2019s another side to consider. It\u2019s not\nonly defendants in a legal case that matter. Less powerful groups have a right\nto bring to justice the perpetrators of violence, discrimination, hate speech,\nenvironmental crimes and Indigenous and other human rights violations.<\/p>\n\n<p>For example, cities on the frontlines of climate change in the USA <a href=\"https:\/\/insideclimatenews.org\/news\/04042018\/climate-change-fossil-fuel-company-lawsuits-timeline-exxon-children-california-cities-attorney-general\">are suing oil companies<\/a> who misled the public about the dangers their products posed to our climate for damages related to the impacts of the climate crisis. Canadian cities like <a href=\"https:\/\/www.greenpeace.org\/canada\/en\/press-release\/8572\/doctors-group-environmental-groups-and-residents-call-on-torontos-city-council-to-hold-big-polluters-accountable-for-climate-costs\/\">Toronto<\/a>, <a href=\"https:\/\/www.greenpeace.org\/canada\/en\/story\/23827\/a-day-in-the-life-of-a-greenpeace-volunteer\/\">Vancouver<\/a>, <a href=\"https:\/\/www.climateliabilitynews.org\/2019\/10\/07\/canada-climate-cases-joseph-arvay\/\">Victoria<\/a> are thinking about it.<\/p>\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">Curious about why cities like <a href=\"https:\/\/twitter.com\/hashtag\/Vancouver?src=hash&amp;ref_src=twsrc%5Etfw\">#Vancouver<\/a> and <a href=\"https:\/\/twitter.com\/hashtag\/Toronto?src=hash&amp;ref_src=twsrc%5Etfw\">#Toronto<\/a> are looking into holding oil companies accountable for <a href=\"https:\/\/twitter.com\/hashtag\/climatechange?src=hash&amp;ref_src=twsrc%5Etfw\">#climatechange<\/a>?<br><br>Check out what <a href=\"https:\/\/twitter.com\/climatekeith?ref_src=twsrc%5Etfw\">@climatekeith<\/a> has to say on <a href=\"https:\/\/twitter.com\/CANADALANDCMNS?ref_src=twsrc%5Etfw\">@CANADALANDCMNS<\/a> &gt;&gt; <a href=\"https:\/\/t.co\/rKVFZ8jS6I\">https:\/\/t.co\/rKVFZ8jS6I<\/a><a href=\"https:\/\/twitter.com\/hashtag\/6ReasonsToSue?src=hash&amp;ref_src=twsrc%5Etfw\">#6ReasonsToSue<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/cdnpoli?src=hash&amp;ref_src=twsrc%5Etfw\">#cdnpoli<\/a><\/p>\u2014 Greenpeace Canada (@GreenpeaceCA) <a href=\"https:\/\/twitter.com\/GreenpeaceCA\/status\/1166062758875553792?ref_src=twsrc%5Etfw\">August 26, 2019<\/a><\/blockquote> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n\n<p><\/p>\n\n<p>So, Greenpeace Canada is going before the Supreme Court of Canada to make our case for better protections by <a href=\"https:\/\/www.scc-csc.ca\/WebDocuments-DocumentsWeb\/38374\/FM080_Intervener_Greenpeace-Canada.pdf\">intervening in two court cases<\/a> that could decide the future of how laws designed to prevent SLAPP suits from continuing get interpreted.&nbsp;<\/p>\n\n<p>We won\u2019t be alone.<\/p>\n\n<p>Other groups intervening in the cases include fellow environmental group Ecojustice, civil liberties groups, media outlets and&nbsp; associations, as well as advocate and service groups for women and survivors of sexual and gender-based violence.<\/p>\n\n<p>One group intervening, the Toronto-based <a href=\"https:\/\/www.scc-csc.ca\/WebDocuments-DocumentsWeb\/38374\/FM120_Intervener_Barbra-Schlifer-Commemorative-Clinic.pdf\">Barbara Schlifer Commemorative Clinic for women experiencing violence,<\/a> says \u201canti-SLAPP measures simultaneously advance the public good and the integrity of the justice system by supporting a culture in which it is safer for women to disclose and possible to hold perpetrators accountable.\u201d<br><\/p>\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">I wrote the cover story of the upcoming issue of <a href=\"https:\/\/twitter.com\/maisonneuvemag?ref_src=twsrc%5Etfw\">@maisonneuvemag<\/a>, which is not a sentence I ever expected to type! <a href=\"https:\/\/t.co\/gyZe6FOF5t\">https:\/\/t.co\/gyZe6FOF5t<\/a><\/p>\u2014 H.G. We also believe that a thoughtful examination of power inequities and litigants\u2019 legal history should factor into the decision.<\/p>\n\n<p>National and global movements to solve climate change, the biodiversity crisis, racism, sexism and economic injustice are growing.
