{"id":280,"date":"2017-03-10T00:00:00","date_gmt":"2017-03-10T00:00:00","guid":{"rendered":"https:\/\/www.greenpeace.org\/canada\/uncategorized\/280\/appeal-court-confirms-resolutes-claims-against-greenpeace-scandalous-and-vexatious\/"},"modified":"2019-11-06T03:29:38","modified_gmt":"2019-11-06T08:29:38","slug":"appeal-court-confirms-resolutes-claims-against-greenpeace-scandalous-and-vexatious","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/canada\/en\/press-release\/280\/appeal-court-confirms-resolutes-claims-against-greenpeace-scandalous-and-vexatious\/","title":{"rendered":"Appeal Court confirms Resolute\u2019s claims against Greenpeace \u201cscandalous and vexatious\u201d"},"content":{"rendered":"<div>\n<p>Toronto\/Montreal, March 10, 2017: Resolute Forest Products\u2019 legal attacks on Greenpeace suffered a major setback yesterday when the Ontario Court of Appeal upheld a ruling that allegations against Greenpeace Canada are \u201cscandalous and vexatious.\u201d<\/p>\n<p>The ruling greatly reduces the scope of Resolute\u2019s $7 million defamation lawsuit against Greenpeace Canada and two staff filed in 2013.<\/p>\n<p>The upheld August 2016 court decision states: \u201cResolute alleges in the Reply that Greenpeace has a strategy of distorting the truth and \u2018sensationalizing\u2019 the evidence in order to appeal to its donor base. There is not a single example pleaded of the defendant Greenpeace doing such a thing.\u201d<\/p>\n<p>\u201cResolute can try to muzzle their watchdogs by filing lawsuits as part of an expensive PR campaign, but they will ultimately fail. Greenpeace will continue to stand by our critique of Resolute\u2019s forestry practices as sound opinion based on reliable scientific evidence,\u201d said Shane Moffatt, Head of Forest Campaign of Greenpeace Canada.<\/p>\n<p>A decision is expected soon on whether Resolute\u2019s second lawsuit, a $300 million dollar case filed in Augusta, Georgia against Greenpeace in the U.S., Greenpeace International and Stand.earth, will be heard in court or dismissed outright. This lawsuit alleges Greenpeace\u2019s campaign to protect the Boreal forest is a \u201ccriminal scheme.\u201d Resolute\u2019s law firm is Kasowitz Benson, who also represents President Donald Trump.<\/p>\n<p>\u201cWe are confident that the courts will continue to dismiss this company\u2019s inflammatory allegations,\u201d said Moffatt.<\/p>\n<p align=\"center\">-30-<\/p>\n<p><strong>Notes for editors:<\/strong><\/p>\n<p>Quotes from the <a href=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/06\/DecisionCorbettJreDivCourtAppeal-ResoluteForestProductsvGreenpeace.pdf\">Ontario Superior Court ruling<\/a>:<\/p>\n<ul type=\"disc\">\n<li>[para. 69] Resolute alleges in the Reply that Greenpeace has a strategy of distorting the truth and \u201csensationalizing\u201d the evidence in order to appeal to its donor base. \u00a0There is not a single example pleaded of the defendant Greenpeace doing such a thing. \u00a0As an allegation of past bad conduct, this is a pleading of presumptively inadmissible similar fact evidence. As an allegation of malice, it is so devoid of particularity as to be scandalous and vexatious.<\/li>\n<li>[para. 51] Resolute\u2019s impugned pleadings \u201chave almost nothing to do with the central allegations of the claims and defences.\u201d<\/li>\n<li>[para. 62] \u201cGreenpeace is an environmental advocacy group. Resolute seems to take issue with this characterization in some places in its reply, suggesting that Greenpeace\u2019s raison d\u2019\u00eatre is to raise money and not to advocate in respect to environmental or social causes in which it believes.
