It upheld the fact that <\/span><span style=\"font-weight: 400;\">Canada failed to meaningfully consult and accommodate the concerns of a litany of First Nations, falling \u201cwell short of the mark, \u201d according to the court\u2019s decision.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The court also found the government made a \u201ccritical error\u201d by basing its decision on a National Energy Board (NEB) report that illegally excluded marine shipping from its review.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Both of these findings place major roadblocks that will be difficult, if not impossible, for this failing pipeline project to overcome.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government\u2019s road forward is unclear and <strong>all construction has been stopped indefinitely<\/strong>.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4230 aligncenter\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/32e20ab3-dd38ca47-f0da-47b0-b17a-e454b8cd2460-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/32e20ab3-dd38ca47-f0da-47b0-b17a-e454b8cd2460-300x225.jpg 300w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/32e20ab3-dd38ca47-f0da-47b0-b17a-e454b8cd2460-768x576.jpg 768w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/32e20ab3-dd38ca47-f0da-47b0-b17a-e454b8cd2460-1024x768.jpg 1024w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/32e20ab3-dd38ca47-f0da-47b0-b17a-e454b8cd2460-453x340.jpg 453w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/32e20ab3-dd38ca47-f0da-47b0-b17a-e454b8cd2460.jpg 1280w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p><b>Consultation.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Most of the concerns raised by the Indigenous Nations that brought the lawsuit aren\u2019t small concerns that will be easy for the Federal Government to address.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Just to cite one example, the pipeline would cross and endanger the primary water supply for the Cold Water First Nation. In the event of a spill that water supply could collapse forcing the community to rely on bottled water. Likely the only way to address that concern is to move the pipeline (not an inexpensive venture).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Many Indigenous Nations will also be pushing the government to uphold its consultation requirements by <strong>living up to the<\/strong><\/span><strong><a href=\"https:\/\/www.un.org\/development\/desa\/indigenouspeoples\/declaration-on-the-rights-of-indigenous-peoples.html\"> U.N. Declaration on the Rights of Indigenous Peoples<\/a><\/strong><span style=\"font-weight: 400;\"> &#8211; an international declaration that Canada has ratified and both<\/span><a href=\"https:\/\/www.huffingtonpost.ca\/2018\/02\/14\/trudeau-pledges-full-recognition-and-implementation-of-indigenous-rights_a_23361841\/\"><span style=\"font-weight: 400;\"> Prime Minister <\/span><span style=\"font-weight: 400;\">Trudeau<\/span><\/a><span style=\"font-weight: 400;\"> and<\/span><a href=\"http:\/\/oktlaw.com\/walking-talk-albertas-new-government-moves-implement-un-declaration-rights-indigenous-peoples\/\"><span style=\"font-weight: 400;\"> Alberta Premier Rachel <\/span><span style=\"font-weight: 400;\">Notley<\/span><\/a><span style=\"font-weight: 400;\"> have said they wish to uphold. That document enshrines the rights of Indigenous Peoples to<\/span><strong><a href=\"https:\/\/www.ohchr.org\/Documents\/Issues\/ipeoples\/freepriorandinformedconsent.pdf\"> Free, Prior and Informed Consent<\/a><\/strong><span style=\"font-weight: 400;\">. Something this project doesn\u2019t have from the vast majority of Indigenous Nations it would impact and something the Federal government is ever likely to get.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Respecting the Prime Minister\u2019s own commitments and the rights of Indigenous Peoples means respecting their right to say no. If the government was to do that and truly live a path of Indigenous reconciliation it would <strong>mean this project is a definite no go.<\/strong><\/span><\/p>\n<p><b>Orcas.<\/b><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4228 aligncenter\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm-300x300.jpg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm-300x300.jpg 300w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm-150x150.jpg 150w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm-768x768.jpg 768w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm-1024x1024.jpg 1024w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm-340x340.jpg 340w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/f934d899-dej2zjsvaaawgwm.jpg 1080w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">The Southern Resident Orca population <\/span><span style=\"font-weight: 400;\">is on the<\/span><a href=\"https:\/\/www.registrelep-sararegistry.gc.ca\/default.asp?lang=En&amp;n=328A7A32-1\"> <span style=\"font-weight: 400;\">edge of extinction<\/span><\/a><span style=\"font-weight: 400;\"> and is facing<\/span><a href=\"https:\/\/www.canada.ca\/en\/environment-climate-change\/services\/species-risk-public-registry\/related-information\/summary-ita-sr-killerwhale.html\"> <span style=\"font-weight: 400;\">imminent threats to its survival<\/span><\/a><span style=\"font-weight: 400;\">. There are only<\/span><strong><a href=\"https:\/\/www.whaleresearch.com\/orca-population\"> 75 Southern Resident Orcas<\/a><\/strong><span style=\"font-weight: 400;\"><strong> left<\/strong> in existence. Another adolescent has already been observed as<\/span><a href=\"https:\/\/www.seattletimes.com\/seattle-news\/environment\/noaa-plans-outside-the-box-response-to-save-j-pod-orca-who-may-have-just-days-to-live\/\"> <span style=\"font-weight: 400;\">extremely emaciated<\/span><\/a><span style=\"font-weight: 400;\">. Because of dwindling food supplies,<\/span><a href=\"http:\/\/www.sciencemag.org\/news\/2016\/02\/standard-ship-noise-may-interfere-orca-communication\"> <span style=\"font-weight: 400;\">increased marine traffic<\/span><\/a><span style=\"font-weight: 400;\">, climate change and other factors the<\/span><a href=\"http:\/\/www.dfo-mpo.gc.ca\/species-especes\/profiles-profils\/killerWhalesouth-PAC-NE-epaulardsud-eng.html\"> <span style=\"font-weight: 400;\">entire population is at risk<\/span><\/a><span style=\"font-weight: 400;\">. One of the reasons these orcas are struggling to survive is because the Chinook salmon they depend on for food<\/span><a href=\"http:\/\/sportfishing.bc.ca\/wp-content\/uploads\/2018\/02\/SRKW-Discussion-Paper-Final-Feb-15-2018.pdf\"> <span style=\"font-weight: 400;\">are declining<\/span><\/a><span style=\"font-weight: 400;\">. Research also suggests that<\/span><a href=\"https:\/\/www.nwfsc.noaa.gov\/assets\/4\/9042_02102017_105951_Crozier.2016-BIOP-Lit-Rev-Salmon-Climate-Effects-2015.pdf\"> <span style=\"font-weight: 400;\">climate change will present enormous challenges for salmon.<\/span><\/a><span style=\"font-weight: 400;\"> The Trans Mountain Expansion project would cross over 1300 streams and rivers on its way to the ocean and would<\/span><a href=\"https:\/\/www.raincoast.org\/reports\/salmon-oil-pipeline\/\"> <span style=\"font-weight: 400;\">put this key food supply even further at risk<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If it goes ahead, the Trans Mountain pipeline expansion could also turn the<\/span><a href=\"http:\/\/greenpeace.org\/usa\/reports\/tanker-superhighway\/\"> <span style=\"font-weight: 400;\">home of the 75 remaining orcas into a tar sands tanker superhighway<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 <strong>bringing over 400 tankers through their critical habitat every year<\/strong>. The noise from a sevenfold increase in tanker traffic would interfere with the<\/span><a href=\"https:\/\/www.raincoast.org\/wp-content\/uploads\/2015\/05\/RCF-SRKW-acoustics-NEB.pdf\"> <span style=\"font-weight: 400;\">orca\u2019s ability to find what little food there is left to eat<\/span><\/a><span style=\"font-weight: 400;\">. A<\/span><a href=\"https:\/\/www.raincoast.org\/wp-content\/uploads\/2016\/10\/Ch-7-The-Game-of-Risk.pdf\"> <span style=\"font-weight: 400;\">catastrophic oil spill<\/span><\/a><span style=\"font-weight: 400;\"> could be the final nail in their coffin (<\/span><a href=\"https:\/\/news.nationalgeographic.com\/2016\/01\/160126-Exxon-Valdez-oil-spill-killer-whales-Chugach-transients\/\"><span style=\"font-weight: 400;\">as the Exxon Valdez spill devastated other orca pods<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These are not easy problems for the federal government to solve. The government has legal obligations under the Species at Risk Act to protect this endangered population. That will be a difficult task for the government to live up to as existing issues are already putting the orca population\u2019s survival at risk never mind the new threats the Trans Mountain pipeline project would bring.<\/span><\/p>\n<p><b>So what does this all mean.<\/b><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-4232 aligncenter\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/9d5e60f9-132252_233183-300x150.jpg\" alt=\"\" width=\"402\" height=\"201\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/9d5e60f9-132252_233183-300x150.jpg 300w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/9d5e60f9-132252_233183-510x255.jpg 510w, https:\/\/www.greenpeace.org\/static\/planet4-canada-stateless\/2018\/09\/9d5e60f9-132252_233183.jpg 600w\" sizes=\"auto, (max-width: 402px) 100vw, 402px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">What this means is that the Trans Mountain pipeline <strong>will face months if not years of delay<\/strong>. Delays that will not see a single shovel hit the ground.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even if the federal government were to overcome these hurdles, the new approval will likely face a new slate of legal challenges that could tie the project up in court, lead to more uncertainty, and mean even more delays.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This is not to mention the fact that the resistance to this project on the ground isn\u2019t going anywhere. Already over 250 people have been arrested confronting this project and if the project ever tries to move forward again the growing movement against this project will be there to stop it.<\/span><\/p>\n<p><b>Conclusion.<\/b><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Take this moment to celebrate.<\/strong> Celebrate this amazing victory for Indigenous rights, for the protection of the lands and waters.
