The District Court of the Hague\u00a0<a class=\"pdf-link\" href=\"https:\/\/elaw.org\/system\/files\/urgenda_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">ruled<\/a>\u00a0that the Dutch government must reduce emissions 25 percent from 1990 levels by 2020, and as governments do, they appealed.<\/p>\n<p><a href=\"https:\/\/earther.gizmodo.com\/in-world-first-a-court-has-reaffirmed-a-governments-re-1829626079\" target=\"_blank\" rel=\"noopener noreferrer\">This month<\/a>, the Hague Court of Appeal\u00a0<a href=\"https:\/\/www.rechtspraak.nl\/Organisatie-en-contact\/Organisatie\/Gerechtshoven\/Gerechtshof-Den-Haag\/Nieuws\/Paginas\/State-must-achieve-higher-reduction-in-greenhouse-gas-emissions-in-short-term.aspx\" target=\"_blank\" rel=\"noopener noreferrer\">confirmed<\/a>\u00a0this ground-breaking decision meaning that the Dutch government MUST increase its climate ambition and reduce emissions to protect the rights of its citizens.<\/p>\n<p><strong>This is a big deal.<\/strong><\/p>\n<p>For the Netherlands, it means that all remaining coal fired power plants must be shut down before 2020 in order for the Dutch government to comply with the court order. Internationally, this ruling sets the stage for what\u2019s to come \u2013 countries must prevent foreseeable violations of human rights resulting from climate change.<\/p>\n<p>No doubt, this will have a beautiful \u201cbutterfly effect\u201d on \u00a0global climate action. The coal ship \u2018Paquis\u2019 had plans to unload coal from Russia for the largest coal-fired power plant in the Netherlands. \u00a9 Bas Beentjes \/ Greenpeace<\/p><\/div>\n<h2><b>Governments are \u201con notice\u201d to increase climate ambition \u2013 or risk being sued<\/b><\/h2>\n<p>Urgenda\u2019s victory in 2015 was the first time ever that a country\u2019s government was held accountable for its contribution to dangerous climate change, and the fact that they won again on appeal means that countries\u00a0who don\u2019t actively prevent climate-related harms are violating people\u2019s human rights.<\/p>\n<p>Even better, the decision by the Court of Appeal was delivered the day after the release of a new UN climate\u00a0<a href=\"http:\/\/www.climatechangenews.com\/2018\/10\/08\/important-years-history-major-un-report-sounds-last-minute-climate-alarm\/\" target=\"_blank\" rel=\"noopener noreferrer\">report\u00a0by the\u00a0<\/a>Intergovernmental Panel on Climate Change (IPCC) which clearly laid out that the\u00a0difference between 1.5\u00b0C and 2\u00b0C degrees of warming as a matter of survival for the countries most at risk from climate change. Even 1.5\u00b0C of warming could cause severe problems to vulnerable populations.\u00a0With this report, governments have been put on notice that they must act now to increase their climate action and protect our human rights from the worsening impacts of climate change.<\/p>\n<p>The combination of the Dutch ruling and the IPCC report is a\u00a0<a href=\"http:\/\/www.climatechangenews.com\/2018\/10\/09\/climate-lawyers-use-un-1-5c-report-sue-governments\/\" target=\"_blank\" rel=\"noopener noreferrer\">warning<\/a>\u00a0to all governments. Despite the Netherlands arguing that matters of climate policy should be decided by politicians, not judges, the Court of Appeal strongly stated the importance of courts in holding States accountable for their human rights obligations \u2013 the Netherlands knew about the 2015 court ruling for the 25% carbon emissions cut, but has only cut its emissions by 13%<\/p>\n<p>The role of courts in ensuring climate justice and respect of human rights was also highlighted by the\u00a0<a href=\"https:\/\/www.ohchr.org\/en\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=23691&amp;LangID=E\" target=\"_blank\" rel=\"noopener noreferrer\">UN Committee on Economic, Social and Cultural Rights<\/a>\u2019 comment on the 1.5C report:<\/p>\n<p>\u201cHuman rights mechanisms have an essential role to play in protecting human rights by ensuring that States avoid taking measures that could accelerate climate change, and that they dedicate the maximum available resources to the adoption of measures that could mitigate climate change.\u201d<\/p>\n<p>In recent years, there\u2019s been a\u00a0<a href=\"https:\/\/www.greenpeace.org\/international\/story\/16715\/four-climate-cases-are-changing-climate-change\/\" target=\"_blank\" rel=\"noopener noreferrer\">wave of cases<\/a>\u00a0around the world of people standing up to fossil fuel companies, governments, or financial institutions and demanding their right to a healthy and safe environment. Except this time, it is preceded by the UN\u2019s most important scientific report to date.<\/p>\n<p>We are facing a moment of truth and how we act now will define the course of human history.\u00a0But we are not alone.
