{"id":1868,"date":"2019-03-07T12:48:22","date_gmt":"2019-03-07T11:48:22","guid":{"rendered":"https:\/\/www.greenpeace.org\/eu-unit\/?p=1868"},"modified":"2019-11-06T09:33:41","modified_gmt":"2019-11-06T08:33:41","slug":"efsa-must-side-with-public-eu-court","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/eu-unit\/issues\/nature-food\/1868\/efsa-must-side-with-public-eu-court\/","title":{"rendered":"EFSA must side with public, not commercial interests, says EU court"},"content":{"rendered":"<p><b>Court rules glyphosate health risk studies must be public<\/b><\/p>\n<p><b>Luxembourg\/Brussels<\/b><span style=\"font-weight: 400;\">\u00a0\u2013 <\/span><a href=\"https:\/\/curia.europa.eu\/jcms\/upload\/docs\/application\/pdf\/2019-03\/cp190025en.pdf\"><span style=\"font-weight: 400;\">In a landmark decision<\/span><\/a><span style=\"font-weight: 400;\">, the EU General Court ruled today that the European Food Safety Authority (EFSA) was wrong to refuse access to toxicity studies related to glyphosate, a controversial pesticide<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1326\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2018\/08\/48d817fa-48d817fa-glyphosatetoxicwarning.jpg\" alt=\"\" width=\"800\" height=\"533\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2018\/08\/48d817fa-48d817fa-glyphosatetoxicwarning.jpg 800w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2018\/08\/48d817fa-48d817fa-glyphosatetoxicwarning-300x200.jpg 300w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2018\/08\/48d817fa-48d817fa-glyphosatetoxicwarning-768x512.jpg 768w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2018\/08\/48d817fa-48d817fa-glyphosatetoxicwarning-510x340.jpg 510w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">The confidential studies were at the heart of EFSA\u2019s favourable assessment of glyphosate, which led to the pesticide\u2019s approval in the EU in 2017, despite a warning by the World Health Organisation linking it to cancer.<\/span><\/p>\n<p><b>Greenpeace EU food policy director Franziska Achterberg<\/b><span style=\"font-weight: 400;\"> said: <\/span><i><span style=\"font-weight: 400;\">\u201cToday&#8217;s judgement is a big step towards transparency and accountability in EU decision-making. People have the right to know the foreseeable health and environmental impacts of EU decisions on products like pesticides, and the Court has vindicated this right. It is shocking that EFSA needed to be reminded in court that its mission is to defend public health, not to protect the commercial interest of glyphosate&#8217;s manufacturers.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">EFSA had denied access to studies and information requested by toxicologist Anthony C. Tweedale and by Members of the European Parliament Heidi Hautala, Mich\u00e8le Rivasi, Benedek J\u00e1vor and Bart Staes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">EFSA justified its refusal on the grounds that disclosure of the requested information could have harmed the commercial and financial interests of the companies which had submitted the studies and that there was no overriding interest supporting the disclosure.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Court has found EFSA&#8217;s decision to be in breach of EU rules on transparency.<\/span><\/p>\n<p><b>The Court\u2019s ruling<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Firstly, the Court stated that the interest in public access to information which relates to the release of chemicals into the environment overrides the protection of commercial interests.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Secondly, the Court recognised that by its use, glyphosate is intended to be discharged into the environment. Therefore, according to the Court \u201c<\/span><i><span style=\"font-weight: 400;\">its foreseeable emissions cannot, therefore, be regarded as purely hypothetical. In any event, glyphosate emissions cannot be classified as merely foreseeable emissions.<\/span><\/i><span style=\"font-weight: 400;\">\u201d In particular, according to the Court, glyphosate emissions into the environment are a reality, since the active substance <\/span><i><span style=\"font-weight: 400;\">\u201cis present particularly as residues in plants, water and food.\u201d<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Finally the Court decided that \u201c<\/span><i><span style=\"font-weight: 400;\">the public must have access not only to information on emissions as such, but also to information <\/span><\/i><i><span style=\"font-weight: 400;\">concerning the medium to long-term consequences of those emissions on the state of the environment<\/span><\/i><i><span style=\"font-weight: 400;\">, such as the effects of those emissions on non-targeted organisms.
