{"id":45028,"date":"2020-09-15T14:45:00","date_gmt":"2020-09-15T12:45:00","guid":{"rendered":"https:\/\/www.greenpeace.org\/eu-unit\/?p=45028"},"modified":"2020-09-15T16:42:16","modified_gmt":"2020-09-15T14:42:16","slug":"gene-edited-crop-cant-stand-the-light-of-day","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/eu-unit\/issues\/nature-food\/45028\/gene-edited-crop-cant-stand-the-light-of-day\/","title":{"rendered":"Gene edited crop can&#8217;t stand the light of day"},"content":{"rendered":"\n<p>On 7 September, Greenpeace and others announced an <a href=\"https:\/\/www.detect-gmo.org\/\">open source detection test<\/a> for the first gene-edited crop on the market, SU Canola, developed by US company Cibus. The test was published in the peer-reviewed scientific journal, <a href=\"https:\/\/www.mdpi.com\/2304-8158\/9\/9\/1245\">Foods<\/a>.<\/p>\n\n<p>SU Canola is a rapeseed engineered with oligonucleotide-directed mutagenesis (ODM), a gene editing technique, to withstand spraying with certain herbicides.\u00a0Products of gene editing fall within the scope of EU GMO law, according to a <a href=\"https:\/\/www.greenpeace.org\/eu-unit\/issues\/climate-energy\/1265\/new-gmos-cannot-escape-testing-and-labelling-under-eu-law-eu-court-rules\/\">European Court of Justice ruling of 2018<\/a>.<\/p>\n\n<figure class=\"wp-block-image size-large  caption-style-blue-overlay caption-alignment-center\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"656\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2020\/09\/a4efc970-gp04lpz-1024x656.jpg\" title=\"Rape Field in Full Bloom in Germany. \u00a9 Paul Langrock \/ Greenpeace\" alt=\"Rape Field in Full Bloom in Germany. \u00a9 Paul Langrock \/ Greenpeace\" class=\"wp-image-44984\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2020\/09\/a4efc970-gp04lpz-1024x656.jpg 1024w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2020\/09\/a4efc970-gp04lpz-300x192.jpg 300w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2020\/09\/a4efc970-gp04lpz-768x492.jpg 768w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2020\/09\/a4efc970-gp04lpz-510x327.jpg 510w, https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2020\/09\/a4efc970-gp04lpz.jpg 1200w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption><div class=\"credit icon-left\"> \u00a9 Paul Langrock \/ Greenpeace<\/div><\/figcaption><\/figure>\n\n<p>When we presented the test, we knew we made an important contribution to the EU regulatory debate as GM developers and some regulators had said gene-edited crops could not be detected in the marketplace, and therefore couldn\u2019t be regulated under existing EU GMO law.&nbsp;<\/p>\n\n<p>We knew this was also relevant for EU national authorities tasked with the enforcement of EU GMO law. Until now, they have not been able to test for this GM rapeseed, which is grown in the US and Canada and has no EU GMO authorisation. When EU officials discussed the ECJ ruling with the Commission, <a href=\"https:\/\/ec.europa.eu\/food\/sites\/food\/files\/plant\/docs\/gmo_modern-biotech_wg_20190425_sum.pdf\">a number of government officials<\/a> said they were \u201cnot able to fulfil all their obligations to carry out controls\u201d and that they couldn\u2019t \u201cin all cases be held responsible for deficiencies in enforcement\u201c.<\/p>\n\n<p>What we didn\u2019t know was that the publication of the detection test would see Cibus, a self-proclaimed pioneer in \u201cprecision\u201d gene editing technology, state that its flagship, first commercial product is in fact the result of a random mutation triggered by a standard laboratory procedure.&nbsp;<\/p>\n\n<p><strong>\u201cPrecision gene editing\u201d turns into accident in the petri dish<\/strong><\/p>\n\n<p>In response to the publication of the detection test, a Cibus official claimed that the varieties currently sold in the U.S. or Canada were \u201cnot gene-edited.\u201d Instead, the intended mutation had \u201c<a href=\"https:\/\/pro.politico.eu\/news\/eu-countries-may-have-a-way-to-find-gene-edited-crops-in-imports\">occurred spontaneously in cell culture and that\u2019s not unusual<\/a>.\u201d&nbsp;<\/p>\n\n<p>The seed industry also ran with that message. They said Cibus had confirmed to them that \u201c<a href=\"https:\/\/www.feednavigator.com\/Article\/2020\/09\/07\/Non-GMO-advocates-hail-first-open-source-detection-test-for-a-gene-edited-GM-crop\">the varieties were in fact developed from spontaneous somaclonal variation<\/a>\u201d, and that it was not possible to determine whether SU Canola is a GMO under EU law.&nbsp;<\/p>\n\n<p>This is a spectacular u-turn from the developer company.&nbsp;<\/p>\n\n<p>When Cibus registered SU Canola in Canada it said it used the ODM technique to create the rapeseed it was planning to put on the market there.&nbsp;Two regulatory agencies, <a href=\"https:\/\/www.canada.ca\/en\/health-canada\/services\/food-nutrition\/genetically-modified-foods-other-novel-foods\/approved-products\/novel-food-information-cibus-canola-event-5715-imidazolinone-sulfonylurea-herbicide-tolerant.html\">Health Canada<\/a> and the <a href=\"https:\/\/web.archive.org\/web\/20200714085942\/https:\/www.inspection.gc.ca\/plant-varieties\/plants-with-novel-traits\/approved-under-review\/decision-documents\/dd-2013-100\/eng\/1427383332253\/1427383674669\">Canadian Food Inspection Agency<\/a> put that on record. The agencies noted that Cibus thought the intended genetic change could be the result of \u201cspontaneous somaclonal variation\u201d but wouldn\u2019t make any firm determination that it was.&nbsp;&nbsp;<\/p>\n\n<p>When the company launched SU Canola on the North American market, it touted it as its \u201c<a href=\"https:\/\/seedworld.com\/canola-crush\/\">first commercial seed product<\/a> developed using its rapid trait development system (RTDS), a patented gene-editing tool\u201d.&nbsp;<\/p>\n\n<p>And when it went to investors in 2019, it said in a <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/1483752\/000114036119002341\/s002596x2_s1a.htm\">preliminary prospectus filed with the US Securities Exchange Commission<\/a> that SU Canola was gene edited.<\/p>\n\n<p>Consequently, the rapeseed was listed as a GMO in the <a href=\"https:\/\/euginius.eu\/euginius\/pages\/gmo_detail.jsf?gmoname=5715\">EU GMO database<\/a> run by German regulator BVL and Wageningen University, and in the <a href=\"http:\/\/bch.cbd.int\/database\/record.shtml?documentid=110268\">Clearinghouse<\/a> of the UN Convention on Biological Diversity.&nbsp;<\/p>\n\n<p>But now that Cibus knows that SU Canola can be detected, the company says the product is not a result of gene editing.&nbsp;<\/p>\n\n<p>And German regulator BVL is taking up Cibus\u2019 cause.<\/p>\n\n<p>It declared that the specific mutation that the new test detects was \u201c<a href=\"https:\/\/www.bvl.bund.de\/SharedDocs\/Fachmeldungen\/06_gentechnik\/2020\/2020_09_09_Fa_Nachweismethode-genomeditierte-Pflanzen.html\">not caused by gene editing<\/a>\u201d.&nbsp; To support this assertion, the BVL used just two recent sources \u2013 Cibus\u2019 SU Canola marketing website and the Canadian Food Inspection Agency\u2019s <a href=\"https:\/\/www.inspection.gc.ca\/plant-varieties\/plants-with-novel-traits\/approved-under-review\/decision-documents\/dd-2013-100\/eng\/1427383332253\/1427383674669\">registration document<\/a>, which was changed a short time ago and no longer mentions Cibus\u2019 gene editing technology.&nbsp; But the public record on this matter is much more substantial. In fact, the BVL itself investigated Cibus\u2019 rapeseed in 2014\/15, and obtained <a href=\"https:\/\/www.testbiotech.org\/sites\/default\/files\/Cibus_bvl_2015_0.pdf\">additional information from the company<\/a> about the nature of the mutation (<em>pages 51-53 of the linked document, released under access to documents rules<\/em>). It states in its <a href=\"https:\/\/euginius.eu\/euginius\/pages\/gmo_detail.jsf?gmoname=5715\">GMO database<\/a> that the genetic change was \u201cintroduced through genome editing\u201d \u2013 duly noting the developer\u2019s \u201chypothesis\u201d that it may not be.&nbsp;<\/p>\n\n<p>Cibus, meanwhile, cannot have it both ways &#8211; tell regulators, farmers and potential investors that its products are made using gene editing, and then turn around and claim they are not.&nbsp;<\/p>\n\n<p><strong>Consumers have a right to know how their food is produced&nbsp;<\/strong><\/p>\n\n<p>What the company\u2019s surprising move reveals is that the GM industry has learnt little &#8211; if anything &#8211; from more than twenty years of clear demands from consumers around the world that they want transparency about GMOs.&nbsp; Instead, the first commercial product of gene editing &#8211; hailed by the industry as a new dawn for genetic engineering &#8211; has gone underground to avoid the light of day.<\/p>\n\n<p>Cibus\u2019 SU Canola is <a href=\"https:\/\/euginius.eu\/euginius\/pages\/gmo_detail.jsf?gmoname=5715\">classified as GMO in the EU<\/a> and cannot be placed on the market or released here without a GMO authorisation.<\/p>\n\n<p>The detection method presented in <em>Foods<\/em> is a standard GMO test that hones in on the genetic changes not on the techniques used to make the GMO.
