European farmers will pay a high price, becoming increasingly dependent on a few seed firms, and risk getting sued by the <\/em><em>multinationals who own patented GMOs. <\/em><em>With no credible proof that new GMOs can withstand the impacts of climate change, <\/em><em>growing corporate control in the food system <\/em><em>means farmers could find it harder<\/em><em> to access and develop climate resilient, locally-adapted plants.<\/em>\u201d<\/p>\n\n<p>The Commission plan would lead to <a href=\"https:\/\/newgmo.org\/2023\/11\/19\/open-letter-serious-concerns-about-the-eu-commission-proposal-on-new-genomic-techniques\/\">more patents<\/a>, extending to conventional breeding and plant traits already present in nature. As a result, farmers and breeders could lose autonomy and the freedom to grow what they want. Today, <a href=\"https:\/\/www.theguardian.com\/environment\/2024\/jan\/25\/plant-patents-large-companies-intellectual-property-small-breeders?utm_source=dlvr.it&amp;utm_medium=twitter\">just four companies<\/a> control over 60% of the seed market worldwide: Bayer, Corteva, ChemChina-Syngenta and BASF.<\/p>\n\n<p>A <a href=\"https:\/\/www.greenpeace.org\/eu-unit\/issues\/nature-food\/46914\/draft-eu-law-on-new-gmos-threatens-legal-rights-of-farmers-faces-ecj-rejection\/\">legal analysis<\/a> by Greenpeace shows that, if adopted as proposed by the Commission, the law could violate EU constitutional law, which guarantees a high level of protection for people\u2019s health and the environment, as well as for farmer and consumer rights. The law could also breach the Cartagena Protocol on biosafety, a binding international treaty for the EU and its member states that regulates the circulation of GMOs across borders. The Cartagena Protocol\u00a0 gives countries the right to decide whether or not to allow imports of GMOs. By deregulating new GMOs, the EU would make this decision impossible for non-EU countries, as the movement of new GM plants across borders would no longer be subject to the procedures of notification and consent that, under the current rules, apply to GMOs before they are exported.<\/p>\n\n<p>In an open letter in November 2023, more than 70 <a href=\"https:\/\/newgmo.org\/2023\/11\/19\/open-letter-serious-concerns-about-the-eu-commission-proposal-on-new-genomic-techniques\/\">scientists and academics<\/a> expressed their concerns about the attempt to rush through this proposal before European elections in June 2024, without sufficient public debate. Several polls and a 2022 petition show that EU citizens across several countries, including France and <a href=\"https:\/\/www.foodwatch.org\/fileadmin\/-DE\/Themen\/Gentechnik\/2023-09-Umfrage_Forsa_Tabellen_Neue_Gentechnik.pdf\">Germany<\/a>, want new GMOs <a href=\"https:\/\/www.slowfood.com\/campaigns\/sign-keep-new-gmos\/\">regulated <\/a>and <a href=\"https:\/\/cdn.greenpeace.fr\/site\/uploads\/2022\/06\/Greenpeace_Sondage-OGM_2022.pdf\">labelled<\/a>.<\/p>\n\n<p>Scientists have warned that <a href=\"https:\/\/ensser.org\/publications\/2023\/statement-eu-commissions-proposal-on-new-gm-plants-no-science-no-safety\/\">science<\/a> has been ignored in the legislative process and that new GMOs carry <a href=\"https:\/\/www.greenpeace.org\/static\/planet4-eu-unit-stateless\/2024\/01\/3873cb5e-press-brief-gmo-legal-analysis-jan2024-2.pdf\">risks<\/a>, which should be managed by <a href=\"https:\/\/www.testbiotech.org\/sites\/default\/files\/Expert_statement_risks_of_NGT_plants.pdf\">risk assessment<\/a>, labelling and traceability.
