These people know that they are particularly vulnerable to climate change. They know it because their lives are already affected by it. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">They see the EU emissions reduction target as falling embarrassingly <\/span><a href=\"https:\/\/climateactiontracker.org\/countries\/eu\/\"><span style=\"font-weight: 400;\">short<\/span><\/a><span style=\"font-weight: 400;\"> of the EU\u2019s own requirements and international law. They need the courts to realise &#8212; as they\u2019ve realised &#8212; that weak targets mean the EU is failing to protect fundamental rights to life, health, occupation and property. They are demanding that EU emissions reduction targets be bold and ambitious and the courts could help make that happen.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Court of Justice of the European Union will decide on whether or not they will accept the \u00a0lawsuit. Like people all over the world who are taking polluters and governments to court on behalf of a healthy planet, they are placing their trust in the EU justice system and hope that the court will step in to protect their rights. They demand that the EU accelerate its action to protect their rights and to live up to its self-proclaimed role as a global leader on climate action.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">A legal victory is by no means certain. The main obstacle they face is whether the European Court will even hear the case. In challenges to legislative acts, the families would have to show how the impacts of climate change are affecting them individually in ways that other people do not suffer, whether it be the unique context of where they live or how they make a living, for example. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The courageous people filing this lawsuit are part of a <\/span><a href=\"https:\/\/www.bloomberg.com\/graphics\/2018-climate-change-lawsuits\/\"><span style=\"font-weight: 400;\">growing movement<\/span><\/a><span style=\"font-weight: 400;\"> all over the world<\/span> <span style=\"font-weight: 400;\">that is using the justice system to hold their governments accountable. The <\/span><a href=\"http:\/\/www.urgenda.nl\/en\/themas\/climate-case\/\"><span style=\"font-weight: 400;\">Urgenda<\/span><\/a><span style=\"font-weight: 400;\"> Foundation\u2019s case against the Netherlands, brought on behalf of 886 Dutch citizens, <\/span><a href=\"https:\/\/elaw.org\/system\/files\/urgenda_0.pdf\"><span style=\"font-weight: 400;\">resulted<\/span><\/a><span style=\"font-weight: 400;\"> in the court requiring the government to take more ambitious and effective action on climate change. This ruling immediately <\/span><a href=\"https:\/\/nltimes.nl\/2017\/10\/11\/new-dutch-energy-policy-exceeds-europe-requirements-cabinet-criticized-enough\"><span style=\"font-weight: 400;\">improved<\/span><\/a><span style=\"font-weight: 400;\"> Dutch policies and even inspired cases in New Zealand, Belgium, Ireland, the UK, Switzerland and recently the families in the <\/span><b>\u00a0<\/b><b><i>#PeoplesClimateCase<\/i><\/b> <span style=\"font-weight: 400;\">against the EU. <\/span><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">The Urgenda climate case is without doubt one of the most important climate decisions ever made. The government appealed, and the case will be in front of the Dutch courts once again on 28 May 2018. \u00a0<\/span><\/p>\n<div id=\"attachment_16718\" style=\"width: 1210px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-16718\" class=\"wp-image-16718 size-full\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/05\/bfb9f13e-gp0stq8rb_medium_res.jpg\" alt=\"Group Portrait of KlimaSeniorinnen in SwitzerlandKlimaseniorinnen \u00a9 Greenpeace \/ Joris van Gennip\" width=\"1200\" height=\"799\" srcset=\"https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/05\/bfb9f13e-gp0stq8rb_medium_res.jpg 1200w, https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/05\/bfb9f13e-gp0stq8rb_medium_res-300x200.jpg 300w, https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/05\/bfb9f13e-gp0stq8rb_medium_res-768x511.jpg 768w, https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/05\/bfb9f13e-gp0stq8rb_medium_res-1024x682.jpg 1024w, https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2018\/05\/bfb9f13e-gp0stq8rb_medium_res-510x340.jpg 510w\" sizes=\"auto, (max-width: 1200px) 100vw, 1200px\" \/><p id=\"caption-attachment-16718\" class=\"wp-caption-text\">An association called KlimaSeniorinnen (Senior Women for Climate Protection) is preparing a legal complaint against the Swiss government challenging weak climate policies.<\/p><\/div>\n<ul>\n<li><b><i>Senior Women for Climate Protection<\/i> await decision by the Federal Administrative Court <\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In October 2016, an association of now more than 1,000 Swiss women aged 65 and older, the Senior Women for Climate Protection (<\/span><a href=\"https:\/\/klimaseniorinnen.ch\/english-documents\/\"><span style=\"font-weight: 400;\">KlimaSeniorinnen<\/span><\/a><span style=\"font-weight: 400;\">), demanded that their government protect their human rights and curb GHG emissions with stronger reduction, targets and measures. \u00a0Elderly people, especially senior women, are amongst the most vulnerable to the impacts of global warming as extreme heat is a real danger to them. The authorities responded to the KlimaSeniorinnen request by refusing to get involved. In January 2018, The Oslo District Court\u00a0<\/span><a href=\"http:\/\/blogs2.law.columbia.edu\/climate-change-litigation\/wp-content\/uploads\/sites\/16\/non-us-case-documents\/2018\/20180104_16-166674TVI-OTIR06_judgment-2.pdf\"><span style=\"font-weight: 400;\">decided<\/span><\/a><span style=\"font-weight: 400;\"> that the Norwegian government does have a duty to protect the right of present and future generations to a healthy environment, but let the government off the hook because it illogically reasoned that the oil extracted in Norway is mostly exported and used outside of Norway.
