They\u2019re also bringing the fight to the courtroom. Like many my age, I spend a lot of time being scared about my future and angry about the past. When half your income goes to rent, and job security presents itself in the form of unpaid internships it is hard to hear that we are lazy, entitled, and obsessed with things like avocados and political correctness. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">But these days, it\u2019s a good time to be a millennial. It feels good to see my generation changing the rules of the game and uniting for a better future. Beyond mobilising, young people are also using the law &#8211; an effective yet imperfect and conservative tool &#8211; to demand intergenerational justice. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">That\u2019s right. Youth around the world, some of whom can\u2019t even vote yet, are suing governments over decades of climate inaction. Some have already succeeded, like in Colombia, where the Supreme Court of Justice <\/span><a href=\"https:\/\/www.dejusticia.org\/en\/en-fallo-historico-corte-suprema-concede-tutela-de-cambio-climatico-y-generaciones-futuras\/\"><span style=\"font-weight: 400;\">ruled in favour<\/span><\/a><span style=\"font-weight: 400;\"> of 25 young people who argued that the government had violated human rights by permitting deforestation in the Amazon, which in turn contributes to climate change. <\/span><\/p>\n<div id=\"attachment_21396\" style=\"width: 1210px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-21396\" class=\"size-full wp-image-21396\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-international-stateless\/2019\/03\/ac4d5121-gp0stskhq_medium_res.jpg\" alt=\"Deforestation in Karipuna Indigenous Land, Brazil \u00a9 Christian Braga \/ Greenpeace\" width=\"1200\" height=\"801\" \/><p id=\"caption-attachment-21396\" class=\"wp-caption-text\">Deforestation in Karipuna Indigenous Land, part of Brazil&#8217;s Amazon<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Most of the youth climate lawsuits are still ongoing. In the US, <\/span><a href=\"https:\/\/www.teenvogue.com\/story\/kids-teens-suing-trump-administration-climate-change\"><span style=\"font-weight: 400;\">21 young plaintiffs<\/span><\/a><span style=\"font-weight: 400;\"> supported by the organisation <\/span><a href=\"https:\/\/www.ourchildrenstrust.org\/\"><span style=\"font-weight: 400;\">Our Children\u2019s Trust<\/span><\/a><span style=\"font-weight: 400;\"> assert that \u201cgovernment-sanctioned climate destruction\u201d has violated the youngest generations\u2019 constitutional rights to life, liberty, and property. By choosing its current energy policy and ignoring the climate crisis, plaintiffs claim that the US government devalues the future of young people and values adults today more. The constitutional lawsuit was brought against the United States government by 21 youth in 2015.<\/p><\/div>\n<p><span style=\"font-weight: 400;\">Similarly, in Canada, a <\/span><a href=\"https:\/\/www.cbc.ca\/news\/canada\/montreal\/young-quebecers-class-action-climate-change-environment-1.5164929\"><span style=\"font-weight: 400;\">class action lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> was launched on behalf of everyone under the age of 35 in the province of Quebec by the youth group <\/span><a href=\"https:\/\/enjeu.qc.ca\/justice-eng\/\"><span style=\"font-weight: 400;\">Environnement Jeunesse<\/span><\/a><span style=\"font-weight: 400;\">. The lawsuit argues that the Canadian government\u2019s inaction on climate change violates young people\u2019s human rights, including their right to equality. Just as student strikes are challenging people\u2019s perceptions and waking up world \u201cleaders\u201d, climate litigation disrupts the legal system and forces it to adapt to modern problems. Governments often claim that the courts are not the appropriate space to decide on complex issues like climate change and that politicians, not judges, should be the ones addressing the crisis. <\/span><a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-46351940\"><span style=\"font-weight: 400;\">We already know how bad that can go<\/span><\/a><span style=\"font-weight: 400;\">. By addressing the courts, youth plaintiffs can take some control in their own hands and be heard on equal footing with world leaders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When there is a government system that is causing such harm to people\u2019s basic rights, it is the duty of judges to intervene and stop the violation. Indeed, courts in the <\/span><a href=\"https:\/\/www.greenpeace.org\/international\/story\/18933\/think-we-cant-win-on-climate-change-this-victory-by-dutch-citizens-will-change-your-mind\/\"><span style=\"font-weight: 400;\">Netherlands<\/span><\/a><span style=\"font-weight: 400;\"> and in a youth climate case in <\/span><a href=\"https:\/\/www.greenpeace.org\/new-zealand\/story\/3-reasons-this-small-countrys-court-decision-will-have-a-big-impact-on-global-climate-action\/\"><span style=\"font-weight: 400;\">New Zealand<\/span><\/a><span style=\"font-weight: 400;\"> have stated that judges have the authority to decide legal questions on climate change, even if those decisions might have political consequences. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a generation plagued by <\/span><a href=\"https:\/\/www2.deloitte.com\/global\/en\/pages\/about-deloitte\/articles\/millennialsurvey.html\"><span style=\"font-weight: 400;\">uncertainty<\/span><\/a><span style=\"font-weight: 400;\"> &#8212; be it financial, romantic, existential &#8212; one thing is clear: young people today will suffer disproportionately from the impacts of the climate breakdown, despite being the least responsible. That\u2019s why we are using all the tools in our arsenal, both in the court of law and in the court of public opinion. The global mobilisation of <\/span><a href=\"https:\/\/www.greenpeace.org\/international\/act\/global-climate-school-strike\/\"><span style=\"font-weight: 400;\">#FridaysForFuture<\/span><\/a><span style=\"font-weight: 400;\"> goes hand-in-hand with youth-led <\/span><a href=\"https:\/\/www.greenpeace.org\/international\/story\/16715\/four-climate-cases-are-changing-climate-change\/\"><span style=\"font-weight: 400;\">climate litigation<\/span><\/a><span style=\"font-weight: 400;\">.
