While the Norwegian Court rightly upholds the Constitution which guarantees everyone&#8217;s right to a healthy environment, it doesn&#8217;t acknowledge the environmental boundaries breached by awarding 10 oil drilling licenses in the Arctic.<\/p>\n\n<p>Read\nthe full judgement text (in Norwegian) <a href=\"http:\/\/www.xn--klimasksml-95a8t.no\/wp-content\/uploads\/2020\/01\/dom.pdf\">here<\/a>.<\/p>\n\n<p>\u201cWe\nare happy the Norwegian Court of Appeals acknowledges current and future\ngenerations\u2019 right to a healthy environment and that right also includes the\nduty to take into account the full emissions from the burning of Norwegian oil,\nwherever that takes place. This is an important legal victory on the right to a\nhealthy environment under the Norwegian Constitution,\u201d said head of Greenpeace\nNorway Frode Pleym.<\/p>\n\n<p>\u201cThis\nis a big step closer to guaranteeing our future and sending a message that we\ncan\u2019t afford to drill for new oil. The Norwegian Court of Appeal is standing\nbehind the constitutional right to a healthy environment, and finding that the\nNorwegian government could be responsible for emissions made by Norwegian oil\nburned abroad,\u201d said head of co-plaintiff Nature &amp; Youth Therese Woie.<\/p>\n\n<p>\u201cStill, the Court finds that the threshold for invalidating\nthe oil drilling licences is not breached. The co-plaintiffs will appeal the\njudgement to Supreme Court, as it is clear that this necessitates further\nreview by the judiciary,\u201d said Frode Pleym.<\/p>\n\n<p>The\nCourt of Appeal additionally found that the case raises important principles\npertaining to the environment and the living conditions for current and future\ngenerations. Thus it has ruled that Greenpeace and Nature and Youth do not need\nto bear the government&#8217;s costs from the District Court nor the Court of Appeal.<\/p>\n\n<p>\u201cPeople,\ngovernment and polluting industries across the world should take note: This is\nwhat can be achieved by a growing and powerful youth and environmental movement\nwho are determined to take ownership of their human right to a sustainable\nfuture,\u201d says Therese Woie, head of Nature &amp; Youth.<\/p>\n\n<p>Norway\nis the 7th biggest exporter of climate-wrecking emissions on the planet.
