The judgement also strengthens the case for African governments to move away from an economic dependence on fossil fuels and towards reliable renewable energy and green employment.<\/p>\n\n<h2 class=\"wp-block-heading\">What exactly did the Constitutional Court rule?<\/h2>\n\n<p class=\"wp-block-paragraph\">On 14 August 2026, South Africa\u2019s Constitutional Court <a href=\"https:\/\/www.greenpeace.org\/africa\/en\/press\/61437\/landmark-judgment-in-south-africa-permanently-halts-shells-wild-coast-oil-and-gas-exploration\/\">permanently halted Shell and Impact Africa\u2019s oil and gas exploration<\/a> off the country\u2019s Wild Coast. This brought a years-long legal battle to a decisive end. South Africa\u2019s apex court, upheld the 2022 Makhanda High Court finding that the exploration right had been unlawfully granted to Shell. It found that the South African government had not meaningfully consulted affected communities, as per the country\u2019s laws.&nbsp;The South African Minister of the Mineral Resources and Energy, who was cited as the Main Respondent,&nbsp; The court warned that allowing this would mean \u201cfinancial investment\u201d could outweigh \u201cgrave constitutional violations\u201d.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">For Wild Coast communities, the judgement confirmed that decisions affecting their ocean, livelihoods, culture and environment cannot be separated from their constitutional rights.<\/p>\n\n<h3 class=\"wp-block-heading\">How did South Africans react to the judgement?<\/h3>\n\n<p class=\"wp-block-paragraph\">Wild Coast communities and environmental organisations <a href=\"https:\/\/naturaljustice.org\/community-rights-come-first-south-africas-constitutional-court-puts-a-final-stop-to-shells-unlawful-oil-and-gas-exploration\/\">welcomed the judgment as a historic victory<\/a> for people whose livelihoods and cultural identities are closely connected to the ocean. Sustaining the Wild Coast\u2019s Sinegugu Zukulu said the communities had gone to court \u201cfor the future and for future generations\u201d, rather than for profit. \u201cFor centuries, colonialism and capitalism have enabled a system that ignores the rights of Indigenous People in their own land. At last we have been able to assert the rights of Indigenous People over the profits of global corporations.\u201d<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">At last we have been able to assert the rights of Indigenous People over the profits of global corporations.<\/p>\n<\/blockquote>\n\n<p class=\"wp-block-paragraph\">Activists and Wild Coast community members also stressed the importance of collaborating across all factions of society in achieving people-powered impact. Local fisher Sazise Maxwell Pekayo said the communities challenging the government were greatly supported by lawyers and civil society groups, adding: \u201cAmandla! Power to the rights of communities!\u201d <a href=\"https:\/\/www.greenpeace.org\/international\/story\/58200\/people-power-stopped-shell-in-south-africa-nonhle-mbuthuma-activist-protesting-shell-at-sea\">Amadiba Crisis Committee activist Nonhle Mbutuma<\/a> said that true development must come from people deciding their own future. Natural Justice\u2019s Delme Cupido said the case demonstrated that public participation is not simply about \u201cticking boxes\u201d, but about putting people\u2019s dignity at the centre of decisions that affect their lives, rights and cultural practices.<\/p>\n\n<h3 class=\"wp-block-heading\">Why did South Africa\u2019s court rule against Shell?<\/h3>\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.saflii.org\/za\/cases\/ZACC\/2026\/33.html\">South African Constitutional Court found<\/a> the original process granting Shell its exploration license failed to give communities meaningful participation in a decision that could affect their livelihoods, environment, culture and spiritual relationship with the sea.&nbsp;Regarding the failure to consider the relevant communities\u2019 spiritual and cultural rights, the High Court found that there was no evidence that the possibility of harm to ancestral beliefs and practices, or any remedial measures to guard against possible harm, were considered by the Minister.<\/p>\n\n<p class=\"wp-block-paragraph\">The court rejected an approach that treated these concerns as merely competing against economic development. As the court put it, \u201cProtection of ecological systems is inseparable from the protection of rights to dignity, culture and livelihood.\u201d It also rejected the argument that consultation during a later renewal could cure the original illegality.<\/p>\n\n<h3 class=\"wp-block-heading\">What does the Shell Wild Coast court judgement mean for local South African communities?<\/h3>\n\n<p class=\"wp-block-paragraph\">Beyond stopping Shell\u2019s exploration, the judgment establishes a significant precedent for communities facing extractive projects along South Africa\u2019s coastline. The court made clear that corporations cannot rely on financial investment to overcome failures to respect constitutional rights.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">Legal Resources Centre\u2019s Kimal Harvey said the judgment confirmed that \u201cno decisions about our land or resources can be made without us\u201d, while Natural Justice\u2019s Melissa Groenink-Groves described it as a victory for coastal communities, constitutional democracy and judicial accountability.&nbsp;<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cPeople and their constitutional rights come before corporate profits.<\/p>\n<\/blockquote>\n\n<p class=\"wp-block-paragraph\">The court also referred to the <a href=\"https:\/\/www.icj-cij.org\/case\/187\/advisory-opinions\">2025 International Court of Justice advisory opinion<\/a> on climate change, emphasising that decisions must account for scientific evidence, international commitments and foreseeable impacts on present and future generations. Greenpeace Africa\u2019s Eugene Perumal said the message was clear: \u201cPeople and their constitutional rights come before corporate profits.\u201d&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">For coastal communities, that principle strengthens their ability to defend livelihoods, heritage and environmental rights when development threatens their way of life.<\/p>\n\n<h2 class=\"wp-block-heading\">What is the background of Shell\u2019s seismic blasting plans off South Africa\u2019s Wild Coast?<\/h2>\n\n<p class=\"wp-block-paragraph\">Shell\u2019s planned <a href=\"https:\/\/www.greenpeace.org\/africa\/en\/blogs\/49695\/samecolonizersdifferentship-seismic-surveys-on-the-wild-coast\/\">seismic exploration off South Africa\u2019s Wild Coast<\/a> involved a five-month survey using powerful airguns to send shockwaves into the seabed approximately every ten seconds. The technology was intended to locate potential oil and gas deposits, but raised serious concerns about its impact on marine ecosystems.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/mg.co.za\/the-green-guardian\/2021-11-25-nature-not-designed-for-seismic-blasting-marine-expert\/\">Experts warned<\/a> that seismic waves can disturb, injure or kill marine life, while successful exploration could lead to further risks from drilling, extraction, transportation and oil spills. Communities were already <a href=\"https:\/\/www.timeslive.co.za\/news\/south-africa\/2019-09-24-were-gutted-kalk-bay-fishers-say-their-way-of-life-is-over-as-prince-harry-visits-harbour\/\">under pressure from industrial fishing<\/a> and other threats to their economic security. Amadiba Crisis Committee activist <a href=\"https:\/\/www.dailymaverick.co.za\/article\/2021-11-29-choppy-waters-more-coastal-surveys-in-the-pipeline-for-south-africa\/\">Nonhle Mbuthuma described the situation<\/a> as another struggle for a community that had spent decades opposing mining on its land. \u201cNow we also must fight against the mining of the ocean,\u201d she said.<\/p>\n\n<p class=\"wp-block-paragraph\">In December 2021, communities and activists joined forces to launch a matter in the Makhanda High Court where an interdict was granted. Shell opposed this and requested a review in the self-same High Court which upheld the original decision. Shell took the matter to the Supreme Court of Appeal, which, whilst not overturning the illegality of the granting of the right, simultaneously opened a backdoor for Shell to retrospectively meet the requirement for meaning consultation. The communities took the matter to the country\u2019s apex court to overturn the Supreme Court of Appeal ruling.<\/p>\n\n<h3 class=\"wp-block-heading\">Why did South Africans stand up against Shell\u2019s planned oil exploration?&nbsp;<\/h3>\n\n<p class=\"wp-block-paragraph\">Activists and local communities against the corporation&#8217;s Wild Coast project also pointed to <a href=\"https:\/\/www.aljazeera.com\/news\/2023\/6\/26\/shell-pipeline-spill-fouls-farms-river-in-nigerias-niger-delta\">Shell\u2019s destructive history in Nigeria&#8217;s Niger Delta<\/a> as a warning of what can happen when oil extraction causes environmental damage. Shell\u2019s Niger Delta track record demonstrated the devastating long-term consequences when corporate interests take precedence over local communities and environmental protection.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">Concerns about the Wild Coast therefore extend beyond the immediate effects of seismic testing: successful exploration could open the door to a much larger fossil fuel industry and the environmental risks that accompany it.<\/p>\n\n<h3 class=\"wp-block-heading\">What risks did Shell\u2019s oil exploration plans pose to Wild Coast communities?<\/h3>\n\n<p class=\"wp-block-paragraph\">The risk of Shell\u2019s oil exploration plans to South African Wild Coast communities extended beyond individual species to the wider health of South Africa\u2019s oceans. Seismic blasts not only affect marine life on which coastal communities depend, but also disturb marine ecosystems that serve as a major defence against the climate crisis.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">Oceans absorb carbon dioxide and heat, while <a href=\"https:\/\/www.newscientist.com\/article\/2243114-kelp-is-coming-how-seaweed-could-prevent-catastrophic-climate-change\/\">kelp forests<\/a> (abundant along South Africa\u2019s coastline) provide valuable ecological benefits such as sequestering carbon, sheltering marine species and protecting shorelines from erosion. With <a href=\"https:\/\/www.greenpeace.org\/international\/story\/77999\/soaring-ocean-temperatures-australias-iconic-marine-wonders-are-under-attack\">marine ecosystems already under severe pressure<\/a> from global heating and rising ocean temperatures, expanding fossil fuel exploration only stands to compound existing threats. The potential profits from oil and gas <a href=\"https:\/\/naturaljustice.org\/community-rights-come-first-south-africas-constitutional-court-puts-a-final-stop-to-shells-unlawful-oil-and-gas-exploration\/\">cannot justify risking communities<\/a>, biodiversity and ecosystems that provide vital protection against climate change.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">Yet, oil and gas corporations <a href=\"https:\/\/www.greenpeace.org\/international\/story\/66551\/totalenergies-in-africa-a-legacy-of-destruction\/\">continue promoting oil exploration across Africa<\/a> because the continent\u2019s resources offer lucrative opportunities for multinational corporations. While they frame extractivism as an economic and development opportunity for African countries, it ultimately serves <a href=\"https:\/\/www.greenpeace.org\/international\/story\/53973\/5-reasons-to-save-the-okavango-delta-from-oil-colonialism\">neocolonial interests<\/a>.<\/p>\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"CRUDE: Wentworth Community vc Big Oil\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/7WVfv7OvnX0?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n<p class=\"wp-block-paragraph\">Despite fossil fuel companies\u2019 already <a href=\"https:\/\/capetimes.co.za\/mercury\/news\/2022-03-24-durban-south-communities-want-compensation-from-oil-refineries-for-alleged-pollution\/\">long history in South Africa<\/a>, the country continues to face <a href=\"https:\/\/omny.fm\/shows\/metro-fm-talk-with-faith-mangope\/sa-unemployment-crisis-deepens-as-jobless-rate-climbs-to-33-6?t=29s&amp;in_playlist=podcast\">shockingly high unemployment<\/a>, remaining the most unequal society in the world. South Africa\u2019s own experience with oil and gas corporations demonstrates the opposite of the prosperity that fossil fuel companies promise. Despite the <a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/85175\/as-war-on-iran-drives-monster-q2-profits-for-big-oil-communities-struggle-with-extreme-weather-and-soaring-costs\">billions these multinational oil companies rake in <\/a>every quarter, communities who live near oil infrastructure (like Wentworth, South Africa) tend to find themselves in <a href=\"https:\/\/www.greenpeace.org\/international\/story\/57110\/big-oils-generational-curse-pollutant-related-epigenetic-changes-keeps-south-africans-in-poverty-cycle\">downward poverty spirals<\/a>. <\/p>\n\n<p class=\"wp-block-paragraph\">Furthermore, weak global tax rules currently allow multinationals in the extractive sector to<a href=\"https:\/\/taxobservatory.world\/publication\/the-global-allocation-of-extractive-windfalls\/\"> shift at least 12% of their global profits to tax havens<\/a>, a figure that rises to 20% of windfall profits in commodity booms. This allows them to <a href=\"https:\/\/www.somo.nl\/the-shell-files\/\">dodge billions of US dollars in taxes<\/a> in countries across Africa, undermining governments\u2019 resources to invest in essentials like schools, hospitals and climate protection.&nbsp;&nbsp;<\/p>\n\n<h2 class=\"wp-block-heading\">Does the Shell Wild Coast court judgement protect South Africa from neocolonial extractivism?<\/h2>\n\n<p class=\"wp-block-paragraph\">South Africa\u2019s Constitutional Court judgement against Shell provides an important legal safeguard against extractive industries pursuing commercial interests at the expense of local communities. By affirming that meaningful public participation, cultural rights, livelihoods and environmental protection cannot be overridden by corporate investment, the judgment strengthens communities\u2019 ability to challenge projects imposed without their consent.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">This may have wider significance for the Southern African Development Community (SADC) region, in particular, and the African continent more broadly where oil, gas and mineral extraction has reproduced unequal relationships in which multinational companies benefit from resources while local people carry environmental and social costs. The judgement establishes that economic development cannot simply be defined by corporate investment or promised jobs. Its abundant sunshine makes utility-scale and <a href=\"https:\/\/theconversation.com\/south-africa-is-overlooking-solar-technology-that-can-keep-generating-electricity-after-sunset-283857\">rooftop solar<\/a> particularly attractive, while strong coastal and inland wind resources provide opportunities for <a href=\"https:\/\/hsrc.ac.za\/news\/equitable-education-and-economies\/wind-energy-in-sa-balancing-global-expertise-and-inclusivity\/\">large-scale wind generation<\/a>. Batteries can store solar and wind electricity for periods when the sun is not shining or wind production falls, while improved transmission networks and smart-grid technology can connect renewable resources with areas of high demand. For example, a new<a href=\"https:\/\/assets.nationbuilder.com\/eurodad\/pages\/7856\/attachments\/original\/1762261207\/Eurodad-GATJ_Make_polluters_pay_november_2025.pdf?1762261207\"> global polluter tax of 20% on the profits <\/a>of the biggest oil and gas corporations, with tax rates progressively increasing over time, could raise more than US $100 billion every year in its first few years. These funds should not only be used to pay for the loss and damage caused by the extreme weather that these polluters drive, but also for climate adaptation and investment into cleaner newer energy technologies like renewables.&nbsp;<\/p>\n\n<p class=\"wp-block-paragraph\">South Africa, alongside all other governments, should seize this opportunity through supporting bold new global tax rules under the <a href=\"https:\/\/www.greenpeace.org\/africa\/en\/blog\/61375\/inc-5-why-the-un-tax-convention-matters-for-climate-justice\/\">Global Tax Treaty currently being negotiated<\/a>, while rolling out higher taxes on the wealthiest polluters at the national level immediately.
