Sogenannte Einsch\u00fcchterungsklagen, oft mit dem englischen Begriff SLAPP (Strategic Lawsuits Against Public Participation) bezeichnet, sind Klagen, bei denen es nicht wirklich um Gerechtigkeit geht. Stattdessen sollen sie zivilgesellschaftliche Organisationen, Journalist:innen und Menschenrechtsaktivist:innen unter Druck setzen, einsch\u00fcchtern<\/strong> und finanziell zerm\u00fcrben. Auch Greenpeace ist davon direkt betroffen: Im vergangenen Februar hat ein US-Gericht unser B\u00fcro in den USA sowie Greenpeace International dazu verurteilt<\/a>, dem \u00d6lkonzern Energy Transfer 345 Millionen US-Dollar Schadensersatz zu zahlen<\/strong>.<\/p>\n\n

Schutz f\u00fcr Zivilgesellschaft und Einzelpersonen in Luxemburg<\/strong><\/h3>\n\n

Nachdem auf EU-Ebene bereits eine Anti-SLAPP-Richtlinie verabschiedet wurde, wird in Luxemburg aktuell \u00fcber deren Umsetzung diskutiert. Ziel ist es, Organisationen und Einzelpersonen besser vor solchen Einsch\u00fcchterungs- und Zensurversuchen zu sch\u00fctzen. Anfang des Jahres hat Justizministerin Elisabeth Margue dazu einen Gesetzentwurf<\/strong><\/a>eingebracht, der genau diesen Schutz vor Einsch\u00fcchterungsklagen st\u00e4rken soll<\/strong>. Wir haben damals den Europarat<\/strong> um eine Einsch\u00e4tzung gebeten, um sicherzugehen, dass der Entwurf auch wirklich solide und wirksam ist.<\/p>\n\n

Zum Rechtsgutachten<\/a><\/td><\/tr><\/tbody><\/table><\/figure>\n\n

Die gute Nachricht? Die Abteilung f\u00fcr Zusammenarbeit im Bereich Meinungsfreiheit \u2013 ein unabh\u00e4ngiges Organ des Europarats \u2013 h\u00e4lt den Gesetzentwurf f\u00fcr eine solide Grundlage zur Umsetzung der EU-Richtlinie<\/strong>. Besonders positiv bewertet sie einige ambitionierte Entscheidungen Luxemburgs<\/strong>, etwa dass die Schutzmechanismen auch auf rein nationale F\u00e4lle ausgeweitet werden und Gerichte k\u00fcnftig die M\u00f6glichkeit haben, von sich aus t\u00e4tig zu werden.<\/p>\n\n

Der Europarat formuliert allerdings auch mehrere Empfehlungen, um den Gesetzentwurf weiter zu st\u00e4rken. Er warnt insbesondere davor, private Strafverfahren vom Anwendungsbereich auszuschlie\u00dfen, das w\u00fcrde eine Hintert\u00fcr \u00f6ffnen, die Unternehmen und m\u00e4chtige Pers\u00f6nlichkeiten nur allzu gern nutzen w\u00fcrden.<\/p>\n\n

Dieses Rechtsgutachten<\/a> zeigt, dass noch Luft nach oben ist. Luxemburg hat jetzt die Chance, sich ein wirklich wirksames Schutzgesetz zu geben<\/strong>, es w\u00e4re schade, auf halbem Weg stehen zu bleiben.<\/p>\n\n

Wenn Stimmen verstummen, leidet die Demokratie<\/strong><\/h3>\n\n

Eine Demokratie, die ihre Whistleblower:innen nicht sch\u00fctzt, ist eine Demokratie mit ernsthaften Defiziten. Genau deshalb m\u00fcssen wir mit allen Mitteln diejenigen verteidigen, die Alarm schlagen, ebenso wie das Recht, zu protestieren und auch unbequeme Meinungen zu \u00e4u\u00dfern.Im vergangenen Juli haben unsere Aktivist:innen auf die Gefahr von Einsch\u00fcchterungsklagen aufmerksam gemacht, weltweit und auch hierzulande. Daf\u00fcr haben sie symbolisch das luxemburgische Widerstandssymbol, die Statue der Gro\u00dfherzogin Charlotte, mit einem Knebel versehen<\/a>.<\/p>\n\n
