{"id":3304,"date":"2018-12-14T17:48:09","date_gmt":"2018-12-14T15:48:09","guid":{"rendered":"https:\/\/www.greenpeace.org\/luxembourg\/?p=3304"},"modified":"2021-01-11T18:42:17","modified_gmt":"2021-01-11T16:42:17","slug":"die-urgenda-klage-ein-historischer-erfolg","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/luxembourg\/de\/aktualitaet\/3304\/die-urgenda-klage-ein-historischer-erfolg\/","title":{"rendered":"Die Urgenda-Klage: Ein historischer Erfolg!"},"content":{"rendered":"<h2 class=\"field--field-blog-article-subtitle\">Klimaklagen im Portrait: Ein Factsheet zur ersten erfolgreichen Klimaklage in den Niederlanden.<\/h2>\n<p><strong>Im Jahr 2013 hat die&nbsp;<a class=\"0\" href=\"https:\/\/www.urgenda.nl\/en\/themas\/climate-case\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">NGO Urgenda vor dem Bezirksgericht Den Haag Klage gegen die Niederlande erhoben,<span class=\"0\"><span class=\"element-invisible\">&nbsp;<\/span><\/span><\/a>&nbsp;weil die Regierung nicht ausreichende Schritte f\u00fcr die Begrenzung des Klimawandels eingeleitet habe. Drei Jahre sp\u00e4ter best\u00e4tigt das Zivilgericht, dass die Klage erfolgreich war.<\/strong><\/p>\n<p>Zusammen mit 900&nbsp;B\u00fcrgern verklagte Urgenda die niederl\u00e4ndische Regierung.&nbsp;Im Zentrum der Anklage&nbsp;steht der Antrag, die Niederlande zu verurteilen, bis 2020 mindestens 25 % CO2-Reduktionen gegen\u00fcber 1990 zu erreichen. In dem genannten Umfang bestehe eine \u2013 der Disposition von Gesetzgeber und Regierung entzogene \u2013 Rechtspflicht zur CO2-Reduktion.<\/p>\n<p>Grundlage des Rechtsstreits ist&nbsp;die&nbsp;verfassungsm\u00e4\u00dfig festgeschriebene F\u00fcrsorgepflicht. Nach Einsch\u00e4tzung des&nbsp;<a class=\"0\" href=\"http:\/\/web.unep.org\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">UNEP<span class=\"0\"><span class=\"element-invisible\">&nbsp;<\/span><\/span><\/a>&nbsp;(United Nations Environment Programme), kann der Erfolg der Klimaklage in den Niederlanden als wegweisend f\u00fcr sp\u00e4tere Urteile gewertet werden.
