Les proc\u00e9dures-b\u00e2illons, connues sous l’acronyme anglais SLAPPs (Strategic Lawsuits Against Public Participation<\/em>), sont des poursuites judiciaires intent\u00e9es non pas pour obtenir justice, mais pour \u00e9puiser financi\u00e8rement et intimider des organisations de la soci\u00e9t\u00e9 civile, des journalistes ou des d\u00e9fenseur\u00b7euses des droits humains.<\/strong> Ce ph\u00e9nom\u00e8ne touche directement Greenpeace : en f\u00e9vrier dernier, un tribunal am\u00e9ricain a condamn\u00e9<\/a> notre bureau aux \u00c9tats-Unis ainsi que Greenpeace International \u00e0 verser 345 millions de dollars de dommages et int\u00e9r\u00eats<\/strong> \u00e0 la compagnie p\u00e9troli\u00e8re Energy Transfer. <\/p>\n\n

Une directive anti-SLAPP pour prot\u00e9ger les organisations et les personnes au Grand-Duch\u00e9<\/strong><\/h3>\n\n

Alors qu\u2019une directive anti-SLAPP a \u00e9t\u00e9 adopt\u00e9e au niveau europ\u00e9en, un projet de transposition de celle-ci est actuellement discut\u00e9 au Luxembourg, afin de prot\u00e9ger les organisations et les personnes de ces tentatives de censure et d\u2019intimidation. En d\u00e9but d\u2019ann\u00e9e, la ministre de la Justice, Elisabeth Margue, a ainsi d\u00e9pos\u00e9 un <\/strong>projet de loi<\/strong><\/a> visant \u00e0 prot\u00e9ger les personnes et organisations contre les proc\u00e9dures-b\u00e2illons.<\/strong> Nous avions alors sollicit\u00e9 l\u2019avis du Conseil de l\u2019Europe<\/strong> afin de nous assurer de la qualit\u00e9 de ce projet.<\/p>\n\n

Je d\u00e9couvre l\u2019avis<\/a><\/td><\/tr><\/tbody><\/table><\/figure>\n\n

La bonne nouvelle ? La Division pour la coop\u00e9ration sur la libert\u00e9 d’expression, un organe ind\u00e9pendant du Conseil de l\u2019Europe, estime que cette proposition de loi constitue une base solide pour la transposition de la directive europ\u00e9enne<\/strong> et salue plusieurs choix ambitieux du Luxembourg<\/strong>, notamment l’extension des garanties aux litiges purement nationaux ainsi que le pouvoir attribu\u00e9 aux tribunaux d’agir d’office ! <\/p>\n\n

Le Conseil de l’Europe formule n\u00e9anmoins plusieurs recommandations afin de renforcer davantage le texte. Il avertit notamment sur l’exclusion des proc\u00e9dures p\u00e9nales priv\u00e9es du champ d’application de la loi, ce qui constituerait une porte d\u00e9rob\u00e9e que les entreprises et les personnalit\u00e9s puissantes ne manqueront pas d’exploiter si elle restait ouverte.<\/p>\n\n

Cet avis juridique<\/a> montre qu’il reste une marge pour aller encore plus loin. Le Luxembourg a l’occasion de se doter d’une l\u00e9gislation v\u00e9ritablement protectrice<\/strong> : il serait dommage de s’arr\u00eater \u00e0 mi-chemin.<\/p>\n\n

Prot\u00e9ger nos voix, prot\u00e9ger la d\u00e9mocratie<\/strong><\/h3>\n\n

Une d\u00e9mocratie qui ne prot\u00e8ge pas ses lanceurs et lanceuses d\u2019alerte est une d\u00e9mocratie qui va mal ; c\u2019est pour cette raison qu\u2019il nous faut, par tous les moyens, d\u00e9fendre celles et ceux qui tirent la sonnette d\u2019alarme, ainsi que le droit \u00e0 manifester et \u00e0 exprimer des opinions contraires.
En juillet dernier, nos activistes attiraient l\u2019attention sur le danger que repr\u00e9sentent les proc\u00e8s-b\u00e2illons dans le monde et chez nous en b\u00e2illonnant symboliquement le symbole de la r\u00e9sistance luxembourgeoise<\/a>, la statue de la Grande-Duchesse Charlotte.<\/p>\n\n

Dans cette optique, aujourd\u2019hui et demain, nous continuerons \u00e0 suivre l’\u00e9volution du dossier \u00e0 la Chambre des D\u00e9put\u00e9s et \u00e0 plaider pour une transposition aussi ambitieuse que possible, \u00e0 la hauteur des enjeux d\u00e9mocratiques que repr\u00e9sente la protection de la soci\u00e9t\u00e9 civile et de la libert\u00e9 de la presse.<\/p>\n\n
