{"id":10590,"date":"2025-03-24T12:20:53","date_gmt":"2025-03-24T10:20:53","guid":{"rendered":"https:\/\/www.greenpeace.org\/romania\/?p=10590"},"modified":"2025-03-25T12:22:23","modified_gmt":"2025-03-25T10:22:23","slug":"primele-reglementari-pentru-comunitatile-de-energie-ce-s-a-rezolvat-si-ce-trebuie-imbunatatit","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/romania\/articol\/10590\/primele-reglementari-pentru-comunitatile-de-energie-ce-s-a-rezolvat-si-ce-trebuie-imbunatatit\/","title":{"rendered":"Primele reglement\u0103ri pentru comunit\u0103\u021bile de energie:\u00a0Ce s-a rezolvat \u0219i ce trebuie \u00eembun\u0103t\u0103\u021bit?"},"content":{"rendered":"\n<p>La 21 ianuarie 2025, Ministerul Energiei a publicat un <a href=\"https:\/\/energie.gov.ro\/proiectul-de-act-normativ-forma-actualizata-a-documentului-postat-in-data-de-18-10-2024-ca-a-urmare-a-preluarii-observatiilor-din-cadrul-procedurii-de-transparenta-decizionala-derulata-de-ministeru\/\">proiect de ordonan\u021b\u0103 de urgen\u021b\u0103<\/a> menit s\u0103 remedieze problemele generate de transpunerea defectuoas\u0103 a RED II prin OUG 163\/2022, care a creat un cadru legislativ incomplet \u0219i imposibil de utilizat pentru cei care doresc s\u0103 \u00eenfiin\u021beze comunit\u0103\u021bi de energie.&nbsp;<\/p>\n\n<p><strong>De\u0219i este un pas necesar \u00eentruc\u00e2t ofer\u0103 clarific\u0103ri privind crearea \u0219i integrarea comunit\u0103\u021bilor de energie \u00een pia\u021b\u0103, proiectul ordonan\u021bei are \u00eenc\u0103 nevoie de \u00eembun\u0103t\u0103\u021biri pentru a sprijini deblocarea acestui tip de proiecte \u00een Rom\u00e2nia \u0219i avansarea tranzi\u021biei energetice.<\/strong><\/p>\n\n<p>Actul a trecut de etapa aviz\u0103rii interministeriale, primind observa\u021bii din partea ministerelor relevante. Urm\u0103torul pas este adoptarea \u00een \u0219edin\u021b\u0103 de Guvern, iar ordonan\u021ba va deveni imediat aplicabil\u0103 dup\u0103 publicarea \u00een Monitorul Oficial. Nu a fost \u00eens\u0103 anun\u021bat\u0103 o dat\u0103 clar\u0103 pentru aceast\u0103 \u0219edin\u021b\u0103.<\/p>\n\n<p><strong>Opt organiza\u021bii active \u00een domeniul comunit\u0103\u021bilor de energie au analizat proiectul Ordonan\u021bei de Urgen\u021b\u0103 \u0219i au transmis Ministerului recomand\u0103ri de \u00eembun\u0103t\u0103\u021bire, astfel \u00eenc\u00e2t reglement\u0103rile s\u0103 sprijine cu adev\u0103rat dezvoltarea acestor ini\u021biative \u00een Rom\u00e2nia.<\/strong><\/p>\n\n<p>\u00cen forma actual\u0103, <strong>ordonan\u021ba trateaz\u0103 doar comunit\u0103\u021bile bazate pe produc\u021bia de energie electric\u0103 din panouri fotovoltaice<\/strong>, de\u0219i directivele europene prev\u0103d un concept mai larg, incluz\u00e2nd \u0219i alte surse regenerabile \u0219i activit\u0103\u021bi conexe, precum mobilitatea sustenabil\u0103 \u0219i sistemele centralizate de \u00eenc\u0103lzire.&nbsp;<\/p>\n\n<p>Proiectul de ordonan\u021b\u0103 nu asigur\u0103 un control real al cet\u0103\u021benilor asupra comunit\u0103\u021bilor de energie \u0219i risc\u0103 s\u0103 permit\u0103 marilor companii s\u0103 domine acest sector. \u00cen plus, limitarea geografic\u0103 impus\u0103 constr\u00e2nge dezvoltarea acestor comunit\u0103\u021bi, contrar spiritului directivelor europene, care permit modele mai flexibile \u0219i incluzive.<\/p>\n\n<p>De asemenea, <strong>comunit\u0103\u021bile de energie vor trebui s\u0103 gestioneze dezechilibrele dintre energia produs\u0103 \u0219i cea consumat\u0103<\/strong>, ceea ce le oblig\u0103 s\u0103 achizi\u021bioneze energia necesar\u0103 din pia\u021ba de echilibrare. Aceasta reprezint\u0103 o provocare semnificativ\u0103, av\u00e2nd \u00een vedere volatilitatea extrem\u0103 a pre\u021burilor pe aceast\u0103 pia\u021b\u0103. \u00cen 2024, s-au \u00eenregistrat valori record de peste 100.000 lei\/MWh, costuri care pot deveni prohibitive pentru comunit\u0103\u021bi, afect\u00e2nd viabilitatea proiectelor lor. Spre deosebire de prosumatori, care beneficiaz\u0103 de un regim mai favorabil \u0219i nu sunt direct responsabili de echilibrare p\u00e2n\u0103 la o anumit\u0103 capacitate instalat\u0103 (400 kW), comunit\u0103\u021bile de energie nu par s\u0103 beneficieze de acelea\u0219i excep\u021bii. Aceast\u0103 situa\u021bie va descuraja ini\u021bierea de proiecte.<\/p>\n\n<p>\u00cen plus, sunt<strong> <\/strong>impuse<strong> obliga\u021bii fiscale pentru energia produs\u0103 \u0219i utilizat\u0103 pentru autoconsum<\/strong>, cu excep\u021bia comunit\u0103\u021bilor care de\u021bin instala\u021bii cu o capacitate instalat\u0103 mai mic\u0103 de 50 kW. Acest prag este mult prea sc\u0103zut pentru o comunitate de energie, care poate include locuin\u021be, institu\u021bii publice, \u0219coli, spitale \u0219i al\u021bi consumatori. Astfel, comunit\u0103\u021bile care dep\u0103\u0219esc aceast\u0103 limit\u0103 vor trebui s\u0103 pl\u0103teasc\u0103 taxe pentru energia pe care o produc \u0219i consum\u0103 intern, ceea ce contravine principiului de sprijinire a produc\u021biei locale de energie regenerabil\u0103.&nbsp;<\/p>\n\n<p><strong>Propunerile formulate de cele opt organiza\u021bii sunt disponibile integral <\/strong><a href=\"https:\/\/drive.google.com\/file\/d\/1VsMp0xpHKMjWL68gIyLeDoAjnh_j_I1B\/view?usp=sharing\"><strong>aici<\/strong><\/a><strong>.<\/strong><\/p>\n\n<p>Ne afl\u0103m \u00eentr-un moment \u00een care reglement\u0103rile pentru comunit\u0103\u021bi de energie trebuie s\u0103 creeze un cadru func\u021bional, echitabil \u0219i favorabil tranzi\u021biei energetice. Este important ca vocea societ\u0103\u021bii civile \u0219i a comunit\u0103\u021bilor locale s\u0103 fie ascultat\u0103 \u0219i integrat\u0103 \u00een procesul de creare a reglement\u0103rilor pentru comunit\u0103\u021bile de energie.<\/p>\n\n<p>Organiza\u021biile semnatare r\u0103m\u00e2n deschise dialogului \u0219i solicit\u0103 Ministerului Energiei s\u0103 \u00eembun\u0103t\u0103\u021beasc\u0103 procesul de reglementare printr-o abordare transparent\u0103 \u0219i incluziv\u0103.
