Fransa o d\u00f6nemde Clemenceau&#8217;yu Hindistan&#8217;a ihra\u00e7 etmi\u015f, ancak ihracat\u0131n AB At\u0131k Sevkiyat Y\u00f6netmeli\u011fi kapsam\u0131nda yasad\u0131\u015f\u0131 oldu\u011funu kabul etmi\u015fti. Sonu\u00e7 olarak, o d\u00f6nemin&nbsp; Cumhurba\u015fkan\u0131 Jacques Chirac geminin Fransa&#8217;ya d\u00f6nmesi emrini vermi\u015fti.<\/p>\n\n<p>&#8220;Tarih maalesef kendini tekrar ediyor. 2006 y\u0131l\u0131nda, Hindistan Y\u00fcksek Mahkemesi ve Fransa Conseil d\u2019Etat, Clemenceau\u2019nun s\u00f6k\u00fclmesine ili\u015fkin Fransa\u2019n\u0131n uluslararas\u0131 hukuka ba\u011fl\u0131 kalmas\u0131n\u0131 \u015fart ko\u015fmu\u015ftur.&#8221; S\u00f6z konusu pek \u00e7ok \u00fclkede biraraya gelen yurtta\u015flar ve sivil toplum kurulu\u015flar\u0131 bu hukuka, \u00e7evre- insan sa\u011fl\u0131\u011f\u0131na, i\u015f ve i\u015f\u00e7i g\u00fcvenli\u011fine ayk\u0131r\u0131 uygulamaya kar\u015f\u0131 tam 16 y\u0131l sonra kazan\u0131lm\u0131\u015f haklar\u0131n\u0131 almak ve kendilerni savunmak i\u00e7in bug\u00fcn tekrar mahkemelere mi ba\u015fvurmak zorunda kalacak?&nbsp;&nbsp;<\/p>\n\n<h2 class=\"wp-block-heading\">Yasad\u0131\u015f\u0131 ihracat<\/h2>\n\n<p>\u00c7evre \u00f6rg\u00fctlerine g\u00f6re, S\u00e3o Paulo&#8217;nun Brezilya&#8217;dan T\u00fcrkiye&#8217;ye transferi de yasa d\u0131\u015f\u0131d\u0131r, zira tehlikeli at\u0131klar\u0131n geri d\u00f6n\u00fc\u015f\u00fcm veya bertaraf edilmek \u00fczere bir AB \u00fclkesine g\u00f6nderilmeleri halinde Akdeniz&#8217;e girmelerine izin vermeyen Barselona S\u00f6zle\u015fmesinin 1996 \u0130zmir Protokol\u00fcn\u00fc (Tehlikeli At\u0131klar\u0131n S\u0131n\u0131r\u00f6tesi Ta\u015f\u0131nmas\u0131 ve Bertaraf\u0131 Taraf\u0131ndan Kirletilmesinin \u00d6nlenmesine \u0130li\u015fkin Protokol) ihlal etmektedir. Brezilya\u2019n\u0131n T\u00fcrkiye\u2019yi kapsayan \u0130zmir Protokol\u00fc\u2019n\u00fc tan\u0131mamas\u0131,&nbsp; Cebelitar\u0131k Bo\u011faz\u0131\u2019ndaki olas\u0131 ge\u00e7i\u015f devletleri olan \u0130spanya, Fas ve \u0130ngiltere\u2019yi&nbsp; bilgilendirmemesi ve onay almamas\u0131 nedeniyle geminin ihracat\u0131 da Basel S\u00f6zle\u015fmesi\u2019ne ayk\u0131r\u0131 bulunmaktad\u0131r.&nbsp;<\/p>\n\n<p>Ayr\u0131ca,bu gemi i\u00e7in ikizi Clemenceau&#8217;da bulunan\u0131n \u00e7ok alt\u0131ndaki seviyelerde asbest, PCB ve zehirli madde seviyeleriileri s\u00fcr\u00fcld\u00fc\u011f\u00fcnden s\u00f6z\u00fc ge\u00e7en STK\u2019lar tehlikeli madde envanterinin a\u015f\u0131r\u0131 eksik bir de\u011ferlendirmeyle ele al\u0131nd\u0131\u011f\u0131na dair \u015f\u00fcphelerin olu\u015ftu\u011funu ileri s\u00fcrmektedir.<\/p>\n\n<p>2000 y\u0131l\u0131nda, Frans\u0131z Donanmas\u0131 u\u00e7ak gemisi S\u00e3o Paulo&#8217;yu Brezilya&#8217;ya satt\u0131. Ge\u00e7en y\u0131l Brezilya donanmas\u0131 gemiyi hurdaya ay\u0131rmaya karar verdi ve gemi a\u00e7\u0131k art\u0131rma sonucu S\u00f6k Denizcilik ve Ticaret Limited isimli T\u00fcrkiye firmas\u0131na sat\u0131ld\u0131. T\u0131pk\u0131&nbsp; Clemenecau\u2019da oldu\u011fu gibi&nbsp; S\u00e3o Paulo da asbest, PCB ve toksik boyalar gibi \u00e7ok miktarda tehlikeli madde i\u00e7erdi\u011finden uluslararas\u0131 hukuk kapsam\u0131nda tehlikeli at\u0131k olarak nitelendirilerek \u00f6zel ticaret kontrollerine tabii. S\u00f6z konusu STK\u2019lar, T\u00fcrkiye\u2019de yap\u0131lacak gemi s\u00f6k\u00fcm\u00fcne ba\u011fl\u0131&nbsp; yasal, \u00e7evresel ve sa\u011fl\u0131k risklerine kar\u015f\u0131, T\u00fcrkiye \u00c7evre \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi&nbsp; Bakanl\u0131\u011f\u0131 ile Brezilya Basel S\u00f6zle\u015fmesi Yetkili Otoritesi\u2019ni (IBAMA) uyarm\u0131\u015ft\u0131r. Bug\u00fcne kadar iki h\u00fck\u00fcmet de bu ikazlar\u0131 reddetmi\u015f ve yasal ihlal iddialar\u0131n\u0131 g\u00f6zard\u0131 etmi\u015ftir.&nbsp;&nbsp;<\/p>\n\n<p>Basel Eylem A\u011f\u0131 3 A\u011fustos tarihinde, IBAMA&#8217;n\u0131n resmi yan\u0131t\u0131n\u0131 a\u00e7\u0131k bir mektupla yan\u0131tlad\u0131 ve Brezilya&#8217;y\u0131 uluslararas\u0131 hukuka sayg\u0131 g\u00f6stermeye ve ihracat\u0131 hukuki ve g\u00fcvenli bir \u00e7\u00f6z\u00fcm bulunana kadar ertelemeye \u00e7a\u011f\u0131rd\u0131.<\/p>\n\n<p>Basel Eylem A\u011f\u0131 (BAN) Direkt\u00f6r\u00fc Jim Puckett, &#8220;T\u00fcrkiye ve Brezilya&#8217;n\u0131n tavr\u0131n\u0131n su\u00e7 te\u015fkil eden at\u0131k ka\u00e7ak\u00e7\u0131l\u0131\u011f\u0131na destek anlam\u0131na gelebilece\u011fini ifade etti. Bildiri daha sonra \u015f\u00f6yle devam etti: &#8220;Anla\u015fma ihlallerinin baz\u0131 b\u00f6l\u00fcmlerini ve s\u0131ralar\u0131n\u0131 kaynak g\u00f6sterdik, ancak buna ra\u011fmen sadece b\u00fcrokratik bir cevap verdiler.&#8221; &#8220;Clemenceau da yapmak zorunda kald\u0131\u011f\u0131m\u0131z gibi, bu olayda da T\u00fcrkiye ve Brezilya&#8217;n\u0131n anla\u015fma y\u00fck\u00fcml\u00fcl\u00fcklerini y\u00fcr\u00fcrl\u00fc\u011fe koymak i\u00e7in birden fazla \u00fclkenin vatanda\u015flar\u0131na ve d\u00fcnyan\u0131n d\u00f6rt bir yan\u0131ndaki sorumlu h\u00fck\u00fcmetlerin yakla\u015f\u0131mlar\u0131na g\u00fcvenmemiz gerekecek.&#8221;<\/p>\n\n<h2 class=\"wp-block-heading\">At\u0131k hesaplar\u0131nda tutars\u0131zl\u0131k<\/h2>\n\n<p>S\u00c3O PAULO i\u00e7in Dan\u0131\u015fman Grieg Green taraf\u0131ndan bir \u201cTehlikeli Madde Envanteri\u201d haz\u0131rland\u0131. Ancak STK&#8217;lar \u015fu anda, bu envanterin b\u00fcy\u00fck miktarlarda asbest, PCB&#8217;ler ve radyoaktif kirlenmeyi tespit edemedi\u011fi y\u00f6n\u00fcnde ciddi kayg\u0131lar\u0131 oldu\u011funu dile getiriyorlar. S\u00e3o Paulo&#8217;nun envanter raporu, B\u00fcro Veritas&#8217;\u0131n Clemenceau i\u00e7in \u00e7\u0131kard\u0131\u011f\u0131 rapor ile kar\u015f\u0131la\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda, sadece tespit edilen tehlikeli madde miktarlar\u0131 bak\u0131m\u0131ndan de\u011fil, ayn\u0131 zamanda numune al\u0131nan oda ve tanklar bak\u0131m\u0131ndan da b\u00fcy\u00fck bir tutars\u0131zl\u0131k oldu\u011fu g\u00f6r\u00fcl\u00fcyor. Sao Paulo&#8217;da odalar\u0131n sadece&nbsp; %12&#8217;si \u00f6rneklenirken, bu oran Clemenceau&#8217;da %82 idi.<\/p>\n\n<p>S\u00c3o PAULO&#8217;nun tehlikeli madde envanteri gemide sadece 9,6 ton asbest kontamine malzeme oldu\u011funu tahmin ediyor. Ancak, S\u00e3o Paulo&#8217;nun karde\u015fi olan Clemenceau en az 600 ton asbest i\u00e7eriyordu. S\u00e3o Paulo&#8217;da daha \u00f6nce ger\u00e7ekle\u015fmi\u015f asbest temizleme operasyonlar\u0131na dair bir kan\u0131t olmad\u0131\u011f\u0131ndan, bu gemide de benzer miktarda asbest bulunmas\u0131 bekleniyor.<\/p>\n\n<p>Ayr\u0131ca Grieg Green taraf\u0131ndan verilen envanterde PCB oran\u0131 yer almamaktad\u0131r. Clemenceau\u2019daki t\u00fcm elektrik kablolar\u0131n\u0131n PCB i\u00e7erdi\u011fi ve her iki u\u00e7ak gemisinin de Fransa\u2019da in\u015fa edildi\u011fi d\u00f6nemde gemi d\u00f6\u015femelerinde, contalarda, kau\u00e7uk par\u00e7alar\u0131nda, yal\u0131t\u0131mda, boyalarda vb. PCB kullan\u0131ld\u0131\u011f\u0131 bilinmesine ra\u011fmen, elektrik kablolar\u0131 \u00fczerinde herhangi bir test yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n\n<p>S\u00c3O PAULO Pasifik&#8217;te atmosferik n\u00fckleer bomba denemesine de kat\u0131ld\u0131\u011f\u0131 i\u00e7in radyoaktif kirlili\u011fe kalkan olabilecek 170 ton kur\u015fun\/kadmiyum boyas\u0131n\u0131n varl\u0131\u011f\u0131 ve radyoaktif ekipman\u0131n \u00f6nceden \u00e7\u0131kar\u0131lmas\u0131 konusunda bilgi eksikli\u011fi, aksi y\u00f6ndeki iddialara ra\u011fmen arac\u0131n kirlenmi\u015f oldu\u011fu y\u00f6n\u00fcnde kayg\u0131lara yol a\u00e7maktad\u0131r.<\/p>\n\n<h2 class=\"wp-block-heading\">T\u00fcrkiye&#8217;de halk g\u00fc\u00e7l\u00fc muhalefette<\/h2>\n\n<p>Gemi yap\u0131s\u0131nda bulunan b\u00fcy\u00fck miktarlardaki asbest ve di\u011fer tehlikeli maddeler g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda T\u00fcrkiye\u2019deki yerel sivil toplum gruplar\u0131, siyasi liderler, teknik uzmanlar ve sendikalar geminin T\u00fcrkiye\u2019ye g\u00f6nderilmesine \u015fiddetle kar\u015f\u0131 \u00e7\u0131k\u0131yorlar. \u0130zmir\u2019de faaliyet g\u00f6steren AL\u00c7EP, FO\u00c7EP, EGECEP, IA ve Polen Ekolojisi gibi yerel \u00e7evre \u00f6rg\u00fctleri, anayasal ya\u015fam haklar\u0131n\u0131 ve \u00e7evreyi savunmak \u00fczere Sao Paulo\u2019nun s\u00f6k\u00fcm\u00fcn\u00fc engellemeye kararl\u0131lar.<\/p>\n\n<p>\u0130\u015f\u00e7i Sa\u011fl\u0131\u011f\u0131 ve \u0130\u015f G\u00fcvenli\u011fi Meclisi g\u00f6n\u00fcll\u00fcs\u00fc, akademisyen Asl\u0131 Odman, &#8220;T\u00fcrkiye gemi s\u00f6k\u00fcm tesislerinde her \u015feyin iyi oldu\u011fu y\u00f6n\u00fcndeki iddialara ra\u011fmen, \u00e7ok miktarda asbest, zehirli boya ve PCB i\u00e7eren zehirli maddelerin i\u015f\u00e7iler ve i\u015f\u00e7i aileleri \u00fczerinde \u00f6l\u00fcmc\u00fcl etkileri var.&#8221; dedi. &#8220;Alia\u011fa ve \u00e7evresinde uzun s\u00fcredir devam eden \u00e7evresel ve sosyal hak ihlalleri var ve bu kez Alia\u011fa ve \u0130zmir&#8217;deki n\u00fcfus, bu ithalat ve gemi s\u00f6k\u00fcm sekt\u00f6r\u00fcnde s\u00fcregelen hesap verebilirlik eksikli\u011fi kar\u015f\u0131s\u0131nda g\u00fc\u00e7l\u00fc bir \u015fekilde \u00f6rg\u00fctleniyor.&#8221;<\/p>\n\n<h2 class=\"wp-block-heading\">Ba\u015fkan Macron&#8217;dan sorumluluk almas\u0131 istendi<\/h2>\n\n<p>Brezilya&#8217;n\u0131n geminin ihracat\u0131n\u0131 durdurma \u00e7a\u011fr\u0131s\u0131n\u0131 geri \u00e7evirmesiyle, STK&#8217;lar Fransa Cumhurba\u015fkan\u0131 Macron&#8217;u S\u00e3o Paulo&#8217;nun T\u00fcrkiye&#8217;ye ihracat\u0131n\u0131 durdurmaya ve S\u00e3o Paulo&#8217;daki toksiklerin ihracat ve m\u00fcteakip y\u00f6netiminin \u00e7evreye zarar vermeyecek \u015fekilde yap\u0131lmas\u0131n\u0131 sa\u011flamaya \u00e7a\u011f\u0131r\u0131yorlar.
