Bu politika belgesi, mevcut durumu analiz ederek, kar\u015f\u0131la\u015f\u0131lan sorunlar\u0131, \u00e7\u00f6z\u00fcm \u00f6nerilerini ve uygulanacak stratejileri sunmaktad\u0131r. Politika belgesinin amac\u0131 sahillerin korunmas\u0131 ve halka a\u00e7\u0131k hale getirilmesi i\u00e7in gerekli ad\u0131mlar\u0131 belirlemektir.<\/p>\n\n<p><br>T\u00fcrkiye&#8217;nin sahil \u015feridi, sadece do\u011fal g\u00fczellikleriyle de\u011fil, ayn\u0131 zamanda k\u00fclt\u00fcrel ve ekolojik \u00f6nemiyle de dikkat \u00e7ekiyor. Ancak, son y\u0131llarda artan \u00f6zelle\u015ftirme ve yap\u0131la\u015fma giri\u015fimleri, sahillere eri\u015fimi belirli bir z\u00fcmreyle k\u0131s\u0131tlarken bir yandan da ciddi bir ekolojik y\u0131k\u0131ma sebep oluyor.<\/p>\n\n<p><br>Gelir da\u011f\u0131l\u0131m\u0131ndaki e\u015fitsizli\u011fin giderek artmas\u0131, sosyal haklar\u0131n her ge\u00e7en g\u00fcn daha \u00f6nemli oldu\u011funu g\u00f6steriyor. T\u00fcrkiye h\u00fck\u00fcmeti, sosyal devlet olarak vatanda\u015flar\u0131na sosyal adaleti sa\u011flama ve refah d\u00fczeyini y\u00fckseltme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirmelidir. \u00d6yle ki, ekonomik e\u015fitsizliklerin derinle\u015fti\u011fi bu d\u00f6nemde, sahiller gibi kamusal alanlar\u0131n herkesin eri\u015fimine a\u00e7\u0131lmas\u0131n\u0131n, sosyal adaletin sa\u011flanmas\u0131 a\u00e7\u0131s\u0131ndan kritik bir ba\u015flang\u0131\u00e7 noktas\u0131 olaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcn\u00fcyoruz. \u00c7\u00fcnk\u00fc sahiller, halk\u0131n dinlenme, e\u011flenme ve bir araya gelme ihtiya\u00e7lar\u0131n\u0131 kar\u015f\u0131layan \u00f6nemli <strong>toplumsal alanlard\u0131r; herkesin ortak mal\u0131d\u0131r.<\/strong><\/p>\n\n<p><br>Sahiller Hepimizin Kampanyas\u0131, T\u00fcrkiye&#8217;nin k\u0131y\u0131lar\u0131n\u0131 koruma ve halka a\u00e7\u0131k hale getirme hedefiyle yola \u00e7\u0131km\u0131\u015ft\u0131r. Bu ba\u011flamda, Greenpeace Akdeniz olarak T\u00fcrkiye&#8217;nin d\u00f6rt bir yan\u0131ndaki sahillerin durumunu belirlemek i\u00e7in kapsaml\u0131 bir harita \u00e7al\u0131\u015fmas\u0131 ger\u00e7ekle\u015ftirdik. Bu harita \u00e7al\u0131\u015fmas\u0131, hem Greenpeace ekibi taraf\u0131ndan ger\u00e7ekle\u015ftirilmi\u015f detayl\u0131 saha \u00e7al\u0131\u015fmalar\u0131ndan hem de kamuya a\u00e7\u0131k bir \u015fekidle toplanm\u0131\u015f ihbarlardan elde edilen verilerden olu\u015fmaktad\u0131r. Bu \u00e7al\u0131\u015fma, sahillerin mevcut durumunu, eri\u015fim sorunlar\u0131n\u0131 ve ekolojik tahribat\u0131 g\u00f6zler \u00f6n\u00fcne seriyor. K\u0131y\u0131 Kanunu ve Anayasa, sahillerin herkesin kullan\u0131m\u0131na a\u00e7\u0131k olmas\u0131 gerekti\u011fini belirtse de, bu yasalar yeterince uygulanm\u0131yor. B\u00fcy\u00fck \u015firketler ve i\u015fletmeler sahil \u015feritlerinde kar odakl\u0131 projelerini y\u00fcr\u00fctmeye kanuna ayk\u0131r\u0131 bir \u015fekilde devam ediyor. Bu durum, halk\u0131n sahile \u00fccretsiz eri\u015fimini ciddi \u015fekilde k\u0131s\u0131tlarken bu alana yap\u0131lan yat\u0131r\u0131mlar ise \u00e7evre tahribat\u0131n\u0131 derinle\u015ftiriyor.&nbsp;<\/p>\n\n<p>\u20603621 Say\u0131l\u0131 K\u0131y\u0131 Kanunu ve T\u00fcrkiye Cumhuriyeti Anayasas\u0131&#8217;n\u0131n 43. Maddesi T\u00fcrkiye&#8217;de k\u0131y\u0131lar\u0131n herkes taraf\u0131ndan e\u015fit ve \u00f6zg\u00fcr kullan\u0131lmas\u0131n\u0131n anayasal bir hak oldu\u011funu korumaktad\u0131r:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>T.C. Anayasas\u0131&nbsp; Madde 43<\/strong>\u2019e g\u00f6re:\n<ul class=\"wp-block-list\">\n<li>\u201cK\u0131y\u0131lar, Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndad\u0131r,<\/li>\n\n\n\n<li>Deniz, g\u00f6l ve akarsu k\u0131y\u0131lar\u0131yla, deniz ve g\u00f6llerin k\u0131y\u0131lar\u0131n\u0131 \u00e7evreleyen sahil \u015feritlerinden yararlanmada \u00f6ncelikle kamu yarar\u0131 g\u00f6zetilir,<\/li>\n\n\n\n<li>K\u0131y\u0131larla sahil \u015feritlerinin, kullan\u0131l\u0131\u015f ama\u00e7lar\u0131na g\u00f6re derinli\u011fi ve ki\u015filerin bu yerlerden yararlanma imkan ve \u015fartlar\u0131 kanunla d\u00fczenlenir\u201d<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>K\u0131y\u0131 Kanunu\u2019nun 5\u2019<\/strong>inci maddesine g\u00f6re:\n<ul class=\"wp-block-list\">\n<li>K\u0131y\u0131lar, Devletin h\u00fck\u00fcm ve tasarrufu alt\u0131ndad\u0131r. <strong>K\u0131y\u0131lar, herkesin e\u015fit ve serbest olarak yararlanmas\u0131na a\u00e7\u0131kt\u0131r,<\/strong><\/li>\n\n\n\n<li>K\u0131y\u0131 ve sahil \u015feritlerinden yararlanmada<strong> \u00f6ncelikle kamu yarar\u0131 g\u00f6zetilir.<\/strong><\/li>\n\n\n\n<li>K\u0131y\u0131da ve sahil \u015feridinde planlama ve uygulama yap\u0131labilmesi i\u00e7in k\u0131y\u0131 kenar \u00e7izgisinin tespiti zorunludur.<strong> <\/strong><strong>Sahil \u015feritlerinde yap\u0131lacak yap\u0131lar k\u0131y\u0131 kenar \u00e7izgisine en fazla 50 metre yakla\u015fabilir.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>K\u0131y\u0131 Kanunu\u2019nun 6\u2019<\/strong>nc\u0131 maddesine g\u00f6re:\n<ul class=\"wp-block-list\">\n<li>\u201cK\u0131y\u0131, herkesin e\u015fitlik ve serbestlikle yararlanmas\u0131na a\u00e7\u0131k olup, buralarda hi\u00e7bir yap\u0131 yap\u0131lamaz; duvar, \u00e7it, parmakl\u0131k, tel \u00f6rg\u00fc, hendek, kaz\u0131k ve benzeri engeller olu\u015fturulamaz\u201d&nbsp;<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>K\u0131y\u0131 b\u00f6lgelerinin<strong> kontrol h\u00fckm\u00fcn\u00fc <\/strong>belirleyen<strong> K\u0131y\u0131 <\/strong><strong>Kanunu\u2019nun<\/strong><strong> 13\u2019<\/strong>\u00fcnc\u00fc maddesine g\u00f6re:&nbsp;\n<ul class=\"wp-block-list\">\n<li>K\u0131y\u0131 Kanunu kkapsam\u0131nda kalan alanlardaki uygulamalar\u0131n kontrol\u00fc; belediye ve m\u00fccavir alan s\u0131n\u0131rlar\u0131 i\u00e7inde <strong>belediye<\/strong>, d\u0131\u015f\u0131nda ise <strong>valilik\u00e7e<\/strong> y\u00fcr\u00fct\u00fcl\u00fcr. \u0130lgili <strong>bakanl\u0131klar\u0131n<\/strong> tefti\u015f ve kontrol yetkileri sakl\u0131d\u0131r.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Kamu yarar\u0131n\u0131n <\/strong>hatlar\u0131n\u0131 belirleyen <strong>Anayasa&#8217;n\u0131n 35. Maddesine<\/strong> g\u00f6re ise:\n<ul class=\"wp-block-list\">\n<li>&nbsp;\u201cHerkes, m\u00fclkiyet ve miras haklar\u0131na sahiptir. Bu haklar, ancak kamu yarar\u0131 amac\u0131yla, kanunla s\u0131n\u0131rlanabilir.<strong> M\u00fclkiyet hakk\u0131n\u0131n kullan\u0131lmas\u0131 toplum yarar\u0131na ayk\u0131r\u0131 olamaz<\/strong>\u201d denilmektedir<em>.<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p>\u00d6te yandan, T\u00fcrkiye\u2019nin k\u0131y\u0131lar\u0131 taraf oldu\u011fu uluslararas\u0131 s\u00f6zle\u015fmeler dolay\u0131s\u0131yla da korunma alt\u0131nda olmal\u0131d\u0131r. Bu protokollerden biri olan <strong>Barselona S\u00f6zle\u015fmesi<\/strong>, Akdeniz\u2019in kirlili\u011fe kar\u015f\u0131 korunmas\u0131n\u0131 ama\u00e7layan ve T\u00fcrkiye&#8217;nin de taraf oldu\u011fu \u00f6nemli bir \u00e7evre koruma anla\u015fmas\u0131d\u0131r. T\u00fcrkiye, Barselona S\u00f6zle\u015fmesi&#8217;ne taraf olarak k\u0131y\u0131 ve deniz ekosistemlerinin korunmas\u0131n\u0131 taahh\u00fct etmi\u015ftir. Ancak, uygulamada kar\u015f\u0131la\u015f\u0131lan \u00e7e\u015fitli sorunlar ve eksiklikler, bu taahh\u00fctlerin yerine getirilmesinde ciddi zorluklar yarat\u0131yor.<\/p>\n\n<p>Bununla birlikte T\u00fcrkiye, Karadeniz k\u0131y\u0131lar\u0131n\u0131 koruma amac\u0131yla haz\u0131rlanm\u0131\u015f olan <strong>B\u00fckre\u015f S\u00f6zle\u015fmesi<\/strong>\u2019nin de taraf\u0131d\u0131r. Ancak, k\u0131y\u0131 b\u00f6lgelerindeki plans\u0131z yap\u0131la\u015fma ve \u00e7evre kirlili\u011fi, bu y\u00fck\u00fcml\u00fcl\u00fcklerin tam anlam\u0131yla yerine getirilmedi\u011fini g\u00f6stermektedir. \u00d6zellikle, yasad\u0131\u015f\u0131 yap\u0131la\u015fma ve k\u0131y\u0131 ekosistemlerinin bozulmas\u0131, Karadeniz\u2019in biyolojik \u00e7e\u015fitlili\u011fi ve \u00e7evresel sa\u011fl\u0131\u011f\u0131 i\u00e7in ciddi tehditler olu\u015fturmaktad\u0131r.<\/p>\n\n<p>Yukar\u0131da belirtilen mevzuata, uluslaras\u0131 s\u00f6zle\u015fmelere ve kamu yarar\u0131 vurgular\u0131na ra\u011fmen baz\u0131 b\u00f6lgelerde bu h\u00fck\u00fcmlere ayk\u0131r\u0131 uygulamalar yap\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6zlemliyoruz. B\u00fcy\u00fck \u015firketlerin, se\u00e7kinlerin ve h\u00fck\u00fcmetin kanuna uygun olmayan bir \u015fekilde sahilleri \u00f6zel ve kar odakl\u0131 yap\u0131lanmaya a\u00e7\u0131yor. K\u0131y\u0131lara eri\u015fim belli z\u00fcmrelerle s\u0131n\u0131rland\u0131r\u0131l\u0131yor. \u2060Greenpeace Akdeniz olarak ba\u015flatt\u0131\u011f\u0131m\u0131z ve kamuya a\u00e7\u0131k bir \u015fekilde hayata ge\u00e7irdi\u011fimiz haritaland\u0131rma \u00e7al\u0131\u015fmas\u0131 \u00e7er\u00e7evesinde Greenpeace Akdeniz saha ekibi Ege B\u00f6lgesinde <strong>39 tane sahil i\u015fgali<\/strong> belgelerken, <strong>Greenpeace<\/strong> <strong>ihbar hatt\u0131na<\/strong> <strong>ise Marmara, Ege, Akdeniz ve Karadeniz B\u00f6lgelerinden&nbsp; (18 Temmuz 2024 itibariyle) 82 tane i\u015fgal bildirimi gelmi\u015ftir.<\/strong> (Bkz. Ek 1.)&nbsp;<\/p>\n\n<p>\u00c7evre Kanunu&#8217;nun 2872 say\u0131l\u0131 maddesine dayanarak haz\u0131rlanan \u00c7evresel Etki De\u011ferlendirmesi (\u00c7ED) Y\u00f6netmeli\u011fi gere\u011fince k\u0131y\u0131lar\u0131 dolayl\u0131 olarak etkileyen herhangi bir faaliyet i\u00e7in \u00e7evresel etkilerin \u00f6nemsiz oldu\u011fu karar\u0131 al\u0131nmadan, ekonomik faaliyetlere te\u015fvik, onay, izin veya ruhsat verilmemesi gerekmektedir. Ancak sahil i\u015fgalinin boyutu her ge\u00e7en g\u00fcn biraz daha artarken \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakanl\u0131\u011f\u0131\u2019n\u0131n, bu uygulamay\u0131 mevzuata uygun ve titiz bir \u015fekilde y\u00fcr\u00fctmedi\u011fi endi\u015fesi ortaya \u00e7\u0131k\u0131yor.&nbsp;<\/p>\n\n<p>K\u0131y\u0131 i\u015fgallerinin boyutu ve i\u015fgal bi\u00e7imi g\u00fcnden g\u00fcne de\u011fi\u015firken, yerel hareketler ise bu alandaki \u00e7al\u0131\u015fmalar\u0131n\u0131 senelerdir s\u00fcrd\u00fcr\u00fcyorlar. T\u00fcrkiye\u2019nin d\u00f6rt bir yan\u0131nda faaliyet g\u00f6steren sivil olu\u015fumlar 18 May\u0131s 2024 tarihinde 17 k\u0131y\u0131da e\u015f zamanl\u0131 bir bas\u0131n a\u00e7\u0131klamas\u0131yla K\u0131y\u0131 Hareketleri Dayan\u0131\u015fma A\u011f\u0131&#8217;n\u0131 (KIYIDA) kurduklar\u0131n\u0131 duyurdular. Ayn\u0131 tarihte Eski \u00c7evre, \u015eehircilik ve \u0130klim De\u011fi\u015fikli\u011fi Bakan\u0131 Mehmet \u00d6zhaseki, yaz itibar\u0131yla &#8216;Denizler Halk\u0131nd\u0131r&#8217; slogan\u0131yla yeni bir proje ba\u015flatacaklar\u0131n\u0131 duyurdu. Ka\u00e7ak ve i\u015fgal yap\u0131lara kar\u015f\u0131 kamu yarar\u0131n\u0131 \u00f6nceliklendirerek \u00e7al\u0131\u015fmalar\u0131n\u0131 s\u00fcrd\u00fcreceklerini ifade etseler dahi bakanl\u0131\u011f\u0131n bu alandaki \u00e7al\u0131\u015fmalar\u0131 \u015fu an i\u00e7in belirsiz.<\/p>\n\n<hr class=\"wp-block-separator has-text-color has-grey-900-color has-alpha-channel-opacity has-grey-900-background-color has-background is-style-default\"\/>\n\n<h4 class=\"wp-block-heading has-large-font-size\"><strong>Sorunlar\u0131n Tan\u0131mlanmas\u0131<\/strong><\/h4>\n\n<p>T\u00fcrkiye&#8217;de k\u0131y\u0131 \u015feridinde kamu kaynaklar\u0131n\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131n\u0131n artmas\u0131 hem \u00e7evre sorunlar\u0131n\u0131 hem de toplumdaki sosyal adaletsizli\u011fi derinle\u015ftiriyor.&nbsp;<\/p>\n\n<p>Gelir da\u011f\u0131l\u0131m\u0131ndaki e\u015fitsizlikler artt\u0131k\u00e7a, sosyal haklar\u0131n \u00f6nemi de daha da art\u0131yor. T\u00fcrkiye h\u00fck\u00fcmeti, sosyal devlet olman\u0131n gere\u011fi olarak, vatanda\u015flar\u0131n\u0131n sosyal adaletini sa\u011flama ve refah seviyelerini y\u00fckseltme sorumlulu\u011funu ta\u015f\u0131mak zorunda. Mevcut ekonomik e\u015fitsizliklerin derinle\u015fti\u011fi bu d\u00f6nemde, sahiller gibi kamusal alanlar\u0131n herkesin eri\u015fimine a\u00e7\u0131lmas\u0131, sosyal adaletin sa\u011flanmas\u0131 i\u00e7in kritik bir ad\u0131m olabilir.
