Energy Transfer, the Big Oil corporation behind the Dakota Access Pipeline, is seeking $300 million in damages from Greenpeace USA and Greenpeace International, accusing these organizations of playing a central role in organizing the Indigenous-led resistance to the pipeline back in 2016. The lawsuit is one of the largest Strategic Lawsuits Against Public Participation (SLAPP) cases ever filed, and one of the biggest cases to go to court in North Dakota. Trial begins on February 24, 2025.<br><br>\u201cThis case is a prime example of corporations abusing the legal system to silence critics and keep their operations secret,\u201d said <strong>Sushma Raman, Greenpeace USA Interim Executive Director.<\/strong> \u201cIt is also a critical test of the future of the First Amendment \u2013 both freedom of speech and peaceful protest \u2013 under the Trump Administration and beyond. But we are fighting back, and we are not fighting back alone.\u201d<\/p>\n\n<p>More than 430 organizations signed an <a href=\"https:\/\/engage.us.greenpeace.org\/M3kmVC7IKku4QFpKhTLhOA2\">open letter to Energy Transfer<\/a> including <a href=\"https:\/\/350.org\/\">350.org<\/a>, <a href=\"https:\/\/www.citizen.org\/\">Public Citizen<\/a>, <a href=\"https:\/\/www.aclund.org\/\">ACLU North Dakota<\/a>, <a href=\"https:\/\/www.seiu.org\/\">SEIU<\/a>, <a href=\"https:\/\/www.ienearth.org\/\">Indigenous Environmental Network<\/a>, and <a href=\"https:\/\/www.amnestyusa.org\/\">Amnesty International USA<\/a> (<a href=\"https:\/\/www.greenpeace.org\/usa\/energy-transfer-open-letter\/\">view full organization list<\/a>) along with public figures such as Billie Eilish, Jane Fonda, Adam McKay, and Susan Sarandon \u2013 plus more than 350,000 individuals from around the world.<\/p>\n\n<p>\u201cOne of the things I really want to stress is that the #noDAPL, Mn\u00ed Wi\u010d\u00f3ni water is life movement grew organically,\u201d&nbsp;<strong>said Waniya Locke, a member of Standing Rock Grassroots<\/strong>. \u201cI want it to be very clear that there were no NGOs that started or organized our resistance. And it was matriarch-led. It was led by women who stood strong, who stood on the riverbanks unarmed.\u201d<\/p>\n\n<p><strong>The claims<\/strong><\/p>\n\n<p>Energy Transfer\u2019s claims against the Greenpeace entities fall into three broad categories: defamation, tortious interference, and on the ground claims.&nbsp;<\/p>\n\n<p>The claims related to defamation allege that the Greenpeace entities made false statements, which caused damages to the company.<br><br>\u201cThe important thing to note here is that by the time Greenpeace entities made any of these statements that are at issue, these were statements that were already widely circulated in the public,\u201d said Deepa Padmanabha. \u201cThese were not statements that Greenpeace invented, and they were all legitimate expressions of the First Amendment protected right to speak.\u201d<\/p>\n\n<p>Energy Transfer also claims that Greenpeace made alleged false statements to financial institutions involved with financing the Dakota Access Pipeline \u2013 and that based on those statements, the financial institutions took action that cost Energy Transfer hundreds of millions of dollars in damages. The financial institutions, however, had their own commitments and conducted their own due diligence regarding the Dakota Access Pipeline.<br><br>\u201cThe last bucket of claims are related to on the ground incidents such as trespass, conversion, and aiding and abetting,\u201d said Padmanabha. \u201cThis is the area of claims that makes it clear that Energy Transfer\u2019s target is much bigger than Greenpeace. Beyond the impact that this could have on the Greenpeace entities, one of the most worrisome things about the case is that it could establish dangerous new legal precedents that could hold any participant at protests responsible for the actions of others at those protests \u2013 including unknown individuals. And you can imagine that this would have a serious chilling effect on anybody who wants to engage in protest.\u201d<br><br>\u201cGreenpeace played an extremely limited role at Standing Rock, and is proud of showing up in solidarity with Standing Rock activists. At no time did Greenpeace engage in property destruction or violence. All claims to the contrary are a reckless disregard for the truth.\u201d<br><\/p>\n\n<p><strong>Fighting back against SLAPP lawsuits<\/strong><\/p>\n\n<p>SLAPP stands for Strategic Lawsuits Against Public Participation. These types of cases masquerade as ordinary civil lawsuits, but their true purpose is to retaliate against those who speak out against harms. Such meritless lawsuits are meant to silence or bankrupt opponents by dragging defendants through a long, lengthy, expensive legal process.&nbsp;<\/p>\n\n<p>As SLAPPs are a growing threat, most U.S. states have put legal protections in place to protect advocates. But in North Dakota \u2013 and 15 other states \u2013 no anti-SLAPP statutes exist. Last Congress, Representatives Raskin, Wyden, and Kiley <a href=\"https:\/\/raskin.house.gov\/2024\/12\/raskin-wyden-kiley-introduce-bipartisan-legislation-promoting-free-speech-cracking-down-on-frivolous-strategic-lawsuits-against-public-participation\">introduced bipartisan legislation to deter corporations from filing SLAPP suits<\/a> and to protect everyone\u2019s right to free speech. In Europe, the European Union\u2019s anti-SLAPP Directive entered into force in May 2024.&nbsp;<\/p>\n\n<p>On Feb 11th, 2025, Greenpeace International initiated the first test of the EU\u2019s new anti-SLAPP Directive by <a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/72706\/greenpeace-international-files-lawsuit-against-energy-transfer-in-first-use-of-eu-anti-slapp-directive\/\">filing a lawsuit against Energy Transfer<\/a> in the Netherlands.<br><br>\u201cEnergy Transfer is attempting to hold Greenpeace International, a dutch-based nonprofit foundation accountable for hundreds of millions of dollars of alleged damages for signing on to a letter with over 500 organisations from more than 50 countries,\u201d said Greenpeace International General Counsel Kristin Casper. \u201cIt is this, along with many more reasons, we believe Energy Transfer\u2019s pending US$300 million suit is a contender for the award of the most blatant SLAPP anywhere in the world.\u201d<\/p>\n\n<p>Big Oil companies Shell, Total, and ENI have also filed SLAPPs against Greenpeace entities in recent years. Just last year, Shell came after Greenpeace UK and Greenpeace International in a multimillion dollar lawsuit. After a quarter of a million people spoke out, the <a href=\"https:\/\/www.greenpeace.org\/international\/press-release\/71763\/shell-settles-multimillion-dollar-slapp-lawsuit-against-greenpeace\/#:~:text=The%20Greenpeace%20defendants%20faced%20over,National%20Lifeboat%20Institution%20(RNLI).\">lawsuit was settled<\/a> in December 2024.<\/p>\n\n<p><br>\u201cGreenpeace has faced a long history of threats,\u201d said Charlie Cray, Greenpeace USA Senior Strategist. \u201cWhen the Rainbow Warrior ship was bombed in 1985, we said \u2018you can\u2019t sink a rainbow.\u2019 And now we\u2019re saying: \u2018you can\u2019t sue a movement.\u2019 Whatever happens in North Dakota, we will continue to campaign for a green and peaceful future.\u201d<\/p>\n\n<p><strong><br>Partner quotes<\/strong><\/p>\n\n<p><em>\u201cThe lawsuit against Greenpeace is <\/em><a href=\"https:\/\/www.ienearth.org\/standing-rock-youth-council-delivers-right-to-self-determination-in-the-context-undrip-at-the-23rd-session-of-unpfii\/\"><em>also an attack on the Indigenous movement<\/em><\/a><em> in our fight for self-determination to protect Mother Earth, our waters, sacred and cultural sites and our youth and future generations.
