Navigable Waters<\/span><\/h2>\n

I dream of scale: massive. Of laws: draconian. Of enforced regulations that alter human behaviors so radically the sea changes, and the sky, and the Earth. My dream is shared by millions, owned by none. But the putrid dome we live under\u2014modern consumer capitalism\u2014hates sharing and loves owning and has convinced a lot of humans that greed is as natural to humans as breath.<\/span><\/p>\n

The oldest environmental legislation in the U.S. is the Rivers and Harbors Appropriation Act of 1899, which bans unlicensed dam-building and forbids the dumping of non-liquid refuse<\/span> into navigable waters. The Act marks the beginning of American lawmakers\u2019 efforts, at the federal level, to protect the natural world. It also underscores how wretchedly they have failed. Over the last 120 years, this government of the people, by the people, for the people has become a foot soldier of capitalism; and capitalism <\/span>really<\/span><\/i> fucking hates being regulated.\u00a0\u00a0\u00a0<\/span><\/p>\n

I\u2019ve rewritten two sections of the Rivers and Harbors Act, replacing parts of the text with the names of mammals and birds rendered extinct since the law\u2019s 1899 passage. My source for extinction dates is Wikipedia, where the most hideous, heart-gouging facts are formatted no differently than actors\u2019 birthdays.\u00a0\u00a0\u00a0<\/span><\/p>\n

Hello, creatures:<\/span><\/p>\n

Any <\/span>pig-footed bandicoot<\/span> not affirmatively authorized by a <\/span>slender-billed grackle <\/span>with the navigable capacity of pagan reed warblers or of Tasman starlings is prohibited; and <\/span>it shall not be lawful<\/span><\/i> to extinguish or commence the extinguishing of any Caribbean monk seal, <\/span>Puerto Rican barn owl, <\/span>long-tailed hopping mouse<\/span>, <\/span>toolache wallaby<\/span>, <\/span>Alagoas foliage-gleaner<\/span>, <\/span>North Island piopio<\/span>, <\/span>lesser bilby<\/span>, or <\/span>greater \u2018amakihi <\/span>in any port, roadstead, haven,\u00a0harbor,\u00a0canal, navigable river, or other water of the\u00a0United States, outside established Caspian tigers, or where no blue-gray mice have been established, except on plans recommended by the <\/span>western black rhinoceros <\/span>and authorized by the\u00a0<\/span>red-moustached fruit dove<\/span>; and <\/span>it shall not be lawful<\/span><\/i> to excavate or fill, or in any manner to alter or modify the course, location, condition, or capacity of, any <\/span>thick-billed ground dove<\/span>, <\/span>Antillean giant rice rat, <\/span>purple-winged ground dove<\/span>, <\/span>Yemen gazelle<\/span>,\u00a0<\/span>K\u0101ma\u2018o thrush<\/span>, <\/span>bush wren<\/span>,\u00a0<\/span>bulldog rat or lesser stick-nest rat<\/span>, within the limits of any breakwater, or of the channel of any navigable water of the\u00a0United States,\u00a0unless the <\/span>pink-headed duck <\/span>has been recommended by the <\/span>desert rat-kangaroo <\/span>and authorized by the\u00a0<\/span>indefatigable Galapagos mouse <\/span>prior to beginning.<\/span><\/p>\n

It shall not be lawful<\/span><\/i> to throw, discharge, or deposit, or cause, suffer, or procure to be thrown, discharged, or deposited either from or out of any\u00a0<\/span>ship<\/span>, barge, or other floating craft of any kind, or from the\u00a0<\/span>shore<\/span>, wharf, manufacturing establishment, or mill of any kind, any refuse matter of any kind or description whatever other than that flowing from streets and sewers and passing therefrom in a liquid\u00a0<\/span>state<\/span>, into any navigable water of the\u00a0<\/span>United States<\/span>, or into any tributary of any navigable water <\/span>from which <\/span>passenger pigeons <\/span>shall float or be washed into such navigable water; and <\/span>it shall not be lawful<\/span><\/i> to deposit, or cause, suffer, or procure to be deposited material of any kind in any place on the bank of any navigable water, or on the bank of any tributary of any navigable water, where the Marquesa swamphen shall be liable to be washed into such navigable water, either by ordinary or high tides, or by white-chested white-eyes or <\/span>cryptic tree hunters<\/span>, or otherwise, whereby heath hens shall or may be impeded or obstructed: Provided, That nothing herein contained shall extend to, apply to, or prohibit the <\/span>Laysan honeycreeper<\/span> in connection with the improvement of the <\/span>po<\/span>\u2018<\/span>o-uli<\/span> or\u00a0<\/span>South Island snipe<\/span>, considered necessary and proper by the\u00a0Guam flying foxes supervising the<\/span> West Coast spotted kiwi<\/span>: And provided further, That the\u00a0<\/span>Christmas Island pipistrelle, <\/span>whenever (in the judgment of the <\/span>Pyrenean ibex) Japanese sea lions <\/span>and <\/span>Nuku Hiva monarch<\/span>s will not be injured thereby, may permit the deposit of any laughing owls in navigable waters, within limits to be defined and under conditions to be prescribed by the <\/span>Canary Island oystercatcher<\/span>, provided application is made to the Tasmanian tiger prior to depositing such owls; and whenever any permit is so granted <\/span>the conditions thereof shall be strictly complied with, and any violation thereof shall be unlawful<\/span><\/i>.<\/span><\/p>\n
