{"id":3028,"date":"2024-10-29T00:00:00","date_gmt":"2024-10-29T00:00:00","guid":{"rendered":"http:\/\/www-prod.greenpeace.org\/usa\/campaign-updates\/3028\/trump-slapps-and-the-erosion-of-democratic-freedoms\/"},"modified":"2024-12-18T20:50:53","modified_gmt":"2024-12-18T20:50:53","slug":"trump-slapps-and-the-erosion-of-democratic-freedoms","status":"publish","type":"post","link":"https:\/\/www.greenpeace.org\/usa\/trump-slapps-and-the-erosion-of-democratic-freedoms\/","title":{"rendered":"Trump, SLAPPs, and the erosion of democratic freedoms"},"content":{"rendered":"<p><span class=\"p4descriptive_paragraph\">SLAPP Lawsuits are a major way people in power silence dissent to conduct business without environmental or social accountability. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Powerful corporations have developed many tactics for silencing protests and public debate around unlawful or controversial activities. <\/span><b>SLAPP (Strategic Lawsuits Against Public Participation) lawsuits and other forms of legal harassment are common strategies for <\/b><a href=\"https:\/\/earthrights.org\/publication\/the-fossil-fuel-industrys-use-of-slapps-and-judicial-harassment-in-the-united-states\/\"><b>closing civic spaces and silencing opponents<\/b><\/a><span style=\"font-weight: 400;\"> through isolation, intimidation, and financial and psychological burdens. They are a major way people in power silence dissent to conduct business without environmental or social accountability.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Trump has used SLAPP tactics against opponents as a private (really rich) citizen. <\/span><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/onpolitics\/2016\/07\/07\/new-usa-today-interactive-database-shows-trump-lawsuits-surpass-4000\/86809010\/\"><span style=\"font-weight: 400;\">Seven cases<\/span><\/a><span style=\"font-weight: 400;\"> of the <\/span><a href=\"https:\/\/www.usatoday.com\/pages\/interactives\/trump-lawsuits\/\"><span style=\"font-weight: 400;\">thousands of lawsuits<\/span><\/a><span style=\"font-weight: 400;\"> he has been party to have been efforts to silence authors, media, and individuals. In his SLAPP case against author Tim O\u2019Brien, Trump said <\/span><b>\u201cI spent a couple of bucks on legal fees, and they spent a whole lot more. I did it to make his life miserable, which I\u2019m happy about\u201d<\/b><span style=\"font-weight: 400;\">. Allies of Trump, like Big Oil and other corporate billionaires, would likely benefit from a lack of interference by a Trump administration if they levy SLAPP cases against critics.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Trump campaign and Project 2025 authors agree that their idea of fixing the federal government is <\/span><a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2023\/09\/trump-desantis-republicans-dismantle-deep-state\/675378\/\"><span style=\"font-weight: 400;\">\u201cto bend or break the bureaucracy to the presidential will\u201d<\/span><\/a><span style=\"font-weight: 400;\">. Major policy changes from the Trump campaign and Project 2025 would give the president authoritarian control over the federal government, including <\/span><a href=\"https:\/\/www.aclu.org\/news\/civil-liberties\/how-trumps-proposed-radical-expansion-of-executive-power-will-impact-our-freedoms\"><span style=\"font-weight: 400;\">power<\/span><\/a><span style=\"font-weight: 400;\"> to use legal tactics and federal agents to silence opponents. <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/07\/17\/us\/politics\/trump-plans-2025.html\"><span style=\"font-weight: 400;\">Trump has long planned to see this through<\/span><\/a><span style=\"font-weight: 400;\">. An expansion of executive power could be abused and undermine fundamental freedoms of speech and assembly, and threaten those who speak out against issues of public concern.\u00a0<\/span><\/p>\n<p><b>Taken together, SLAPP cases from the private sector and weaponization of executive power in the public sector create a one-two punch against activism and the right to dissent and protest.<\/b><\/p>\n<p><center><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/Q_Uh-NfuZrE?si=JY-jsabm8fwopclF\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/center><\/p>\n<h2><b><i>Private Sector SLAPPs<\/i><\/b><\/h2>\n<p><b>SLAPPs and related legal tactics have been used to silence environmental and social justice activists, <\/b><a href=\"https:\/\/earthrights.org\/wp-content\/uploads\/SLAPP-Policy-Brief-2022.pdf\"><b>especially by fossil fuel corporations<\/b><\/a><b> and the ultra-wealthy<\/b><span style=\"font-weight: 400;\">. As a private citizen, Trump sued comedian <\/span><a href=\"https:\/\/www.reuters.com\/article\/lifestyle\/trump-withdraws-orangutan-lawsuit-against-comic-bill-maher-idUSBRE9310PL\/\"><span style=\"font-weight: 400;\">Bill Maher<\/span><\/a><span style=\"font-weight: 400;\"> for comparing him to an orangutan and former Miss Pennsylvania <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2016\/sep\/04\/sheena-monnin-donald-trump-miss-usa-lawsuit\"><span style=\"font-weight: 400;\">Sheena Monnin<\/span><\/a><span style=\"font-weight: 400;\"> for criticizing the Trump-owned Miss Universe Organization and calling the Miss USA contest \u201crigged\u201d. He sued author Tim O\u2019Brien for writing that Trump was <\/span><a href=\"https:\/\/law.justia.com\/cases\/new-jersey\/appellate-division-published\/2008\/a3905-06-opn.html\"><span style=\"font-weight: 400;\">\u201conly\u201d worth<\/span><\/a><span style=\"font-weight: 400;\"> around $150-250 millions in a 2005 biography. He demanded $5 billion from O\u2019Brien in damages for such <\/span><a href=\"https:\/\/variety.com\/2006\/biz\/markets-festivals\/trump-fires-off-suit-against-biographer-1117936753\/\"><span style=\"font-weight: 400;\">\u201cvile statements\u201d<\/span><\/a><span style=\"font-weight: 400;\"> \u2013 the case was later <\/span><a href=\"https:\/\/www.nytimes.com\/2009\/07\/16\/business\/media\/16trump.html\"><span style=\"font-weight: 400;\">dismissed<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In his 2016 campaign, Trump has called for <\/span><a href=\"https:\/\/anti-slapp.org\/trump-and-the-first-amendment\"><span style=\"font-weight: 400;\">opening up libel laws<\/span><\/a><span style=\"font-weight: 400;\"> that would make it easier to sue critics and <\/span><a href=\"https:\/\/www.politico.com\/blogs\/on-media\/2016\/02\/donald-trump-libel-laws-219866\"><span style=\"font-weight: 400;\">\u201cwin lots of money\u201d<\/span><\/a><span style=\"font-weight: 400;\">. By relaxing libel laws, Trump would reduce protections for news organizations, journalists, and other groups to oppose and critique powerful individuals and corporations. <\/span><a href=\"https:\/\/www.unesco.org\/en\/articles\/defamation-laws-and-slapps-increasingly-misused-curtail-freedom-expression\"><span style=\"font-weight: 400;\">Weakening libel laws<\/span><\/a><span style=\"font-weight: 400;\"> would make it easier to file SLAPP cases. Leaders should be passing federal <\/span><a href=\"https:\/\/www.freedomforum.org\/anti-slapp-laws\/\"><span style=\"font-weight: 400;\">anti-SLAPP laws<\/span><\/a><span style=\"font-weight: 400;\"> that prevent egregious, vindictive abuses of legal systems.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Big <\/span><a href=\"https:\/\/www.wsj.com\/politics\/elections\/elon-musk-has-said-he-is-committing-around-45-million-a-month-to-a-new-pro-trump-super-pac-dda53823\"><span style=\"font-weight: 400;\">donors<\/span><\/a><span style=\"font-weight: 400;\"> to the Trump campaign like <\/span><a href=\"https:\/\/www.washingtonpost.com\/technology\/2024\/03\/25\/musk-x-lawsuit-slapp-center-digital-hate\/\"><span style=\"font-weight: 400;\">Elon Musk<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.greenpeace.org\/usa\/6-reasons-why-energy-transfers-lawsuit-against-greenpeace-is-outrageous\/\"><span style=\"font-weight: 400;\">Kelcy Warren<\/span><\/a><span style=\"font-weight: 400;\"> have also used SLAPP cases against their critics. Musk\u2019s lawsuit against the Center for Countering Digital Hate attempted to intimidate and stop researchers from investigating hate speech and misinformation being posted on X (the case was <\/span><a href=\"https:\/\/www.nbcnews.com\/tech\/tech-news\/elon-musk-x-twitter-ccdh-lawsuit-rcna144960\"><span style=\"font-weight: 400;\">thrown out<\/span><\/a><span style=\"font-weight: 400;\"> by the judge). Musk also <\/span><a href=\"https:\/\/www.cnn.com\/2024\/06\/13\/tech\/elon-musk-x-lawsuit-media-matters\/index.html\"><span style=\"font-weight: 400;\">sued<\/span><\/a><span style=\"font-weight: 400;\"> nonprofit Media Matters for their report on antisemitic and pro-Nazi content on X. Warren, an oil and gas magnate, issued a <\/span><a href=\"https:\/\/caselaw.findlaw.com\/court\/tx-court-of-appeals\/2243798.html\"><span style=\"font-weight: 400;\">SLAPP lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> against Beto O\u2019Rourke after he critiqued Warren\u2019s massive profits during the 2021 Texas winter storm. The case was <\/span><a href=\"https:\/\/www.texastribune.org\/2023\/12\/15\/kelcy-warren-defamation-beto-orourke\/\"><span style=\"font-weight: 400;\">dismissed<\/span><\/a><span style=\"font-weight: 400;\">. Warren\u2019s company Energy Transfer is currently <\/span><a href=\"https:\/\/www.greenpeace.org\/usa\/energy-transfer-lawsuit-story\/\"><span style=\"font-weight: 400;\">suing Greenpeace in the US and Greenpeace International<\/span><\/a><span style=\"font-weight: 400;\"> in another SLAPP suit for <\/span><a href=\"https:\/\/www.greenpeace.org\/usa\/6-reasons-why-energy-transfers-lawsuit-against-greenpeace-is-outrageous\/\"><span style=\"font-weight: 400;\">standing in solidarity<\/span><\/a><span style=\"font-weight: 400;\"> with water protectors in opposition of the Dakota Access Pipeline.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">EarthRights <\/span><a href=\"https:\/\/earthrights.org\/wp-content\/uploads\/SLAPP-Policy-Brief-2022.pdf\"><span style=\"font-weight: 400;\">found 152 cases<\/span><\/a><span style=\"font-weight: 400;\"> where the oil and gas industry used SLAPPs, legal harassment, and similar tactics against opponents between 2012 and 2022. These cases directly attack constitutionally-protected First Amendment rights to speak on threats to the public. Often, <\/span><b>cases and legal tactics levied by the oil and gas industry are particularly <\/b><a href=\"https:\/\/www.business-humanrights.org\/en\/big-issues\/corporate-legal-accountability\/materials-on-slapps\/\"><b>expensive and aggressive against activists<\/b><\/a><span style=\"font-weight: 400;\">. While some US states have adopted some anti-SLAPP legislation, many are <\/span><a href=\"https:\/\/www.rcfp.org\/introduction-anti-slapp-guide\/\"><span style=\"font-weight: 400;\">still at risk<\/span><\/a><span style=\"font-weight: 400;\"> and there are <\/span><a href=\"https:\/\/www.eff.org\/deeplinks\/2022\/09\/its-time-federal-anti-slapp-law-protect-online-speakers\"><span style=\"font-weight: 400;\">no federal protections<\/span><\/a><span style=\"font-weight: 400;\"> against such tactics. <\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-94325 size-medium\" src=\"https:\/\/www.greenpeace.org\/static\/planet4-usa-stateless\/2024\/11\/a9c492f7-gp0stqbvw.jpg\" alt=\"Greenpeace stands with other activists and water protectors at the Dakota Access Pipeline Day of Action San Francisco in 2016.\" width=\"300\" height=\"200\" \/><\/p>\n<h2><b><i>Dangerous Expansions of Executive Power<\/i><\/b><\/h2>\n<p><span style=\"font-weight: 400;\">On the campaign trail, Trump has threatened to use <\/span><a href=\"https:\/\/www.ncja.org\/crimeandjusticenews\/experts-say-trump-could-make-good-on-revenge-prosecutions\"><span style=\"font-weight: 400;\">revenge prosecutions<\/span><\/a><span style=\"font-weight: 400;\"> against his rivals and opponents. During his first term in office, Trump sought to <\/span><a href=\"https:\/\/www.justsecurity.org\/98703\/chronology-trump-justice-department\/\"><span style=\"font-weight: 400;\">punish his perceived enemies<\/span><\/a><span style=\"font-weight: 400;\"> using legal action. If he wins another presidential term, it is likely that he will seek to <\/span><a href=\"https:\/\/www.voanews.com\/a\/trump-s-vows-of-revenge-against-his-opponents-gain-volume-\/7650528.html\"><span style=\"font-weight: 400;\">fulfill his promises<\/span><\/a><span style=\"font-weight: 400;\"> by abusing presidential powers once in office.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Project 2025 is a detailed pro-Trump agenda that echoes many of <\/span><a href=\"https:\/\/www.cbsnews.com\/news\/project-2025-proposals-trump-policies\/\"><span style=\"font-weight: 400;\">policies from Trump\u2019s administration<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-07-18\/project-2025-does-trump-support-it-his-plan-versus-what-it-says\"><span style=\"font-weight: 400;\">promises<\/span><\/a><span style=\"font-weight: 400;\"> he\u2019s made on the campaign trail. A top priority from both groups is to transform the Department of Justice (DOJ). Instead of being insulated from political considerations (as has been <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/06\/15\/us\/politics\/trump-indictment-justice-department.html\"><span style=\"font-weight: 400;\">the norm<\/span><\/a><span style=\"font-weight: 400;\"> since the Watergate scandal), <\/span><a href=\"https:\/\/www.themarshallproject.org\/2024\/07\/20\/trump-project-2025-crime-prosecutors\"><span style=\"font-weight: 400;\">DOJ would be expected to litigate<\/span><\/a><span style=\"font-weight: 400;\"> according to the presidential agenda. Given the recent Supreme Court ruling on <\/span><a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/23-939_e2pg.pdf\"><span style=\"font-weight: 400;\">presidential immunity from criminal prosecution<\/span><\/a><span style=\"font-weight: 400;\">, this chilling proposition makes the president both more powerful and less accountable. Project 2025 even advocates for DOJ to compel <\/span><a href=\"https:\/\/www.americanprogress.org\/article\/project-2025-compels-local-prosecutors-to-enforce-extreme-right-wing-laws\/\"><span style=\"font-weight: 400;\">state and local <\/span><\/a><span style=\"font-weight: 400;\">prosecutors to follow federal priorities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This restructuring of the DOJ weaponizes the department into a political unit that would <\/span><a href=\"https:\/\/www.aclu.org\/news\/civil-liberties\/how-trumps-proposed-radical-expansion-of-executive-power-will-impact-our-freedoms\"><span style=\"font-weight: 400;\">enable the president<\/span><\/a><span style=\"font-weight: 400;\"> to impose legal action on opponents, or investigative journalists, activists, nonprofits, academics, politicians, and individuals the president disfavors. The FBI would likely refocus its priorities to investigating groups that speak out against the president or powerful allies, a <\/span><a href=\"https:\/\/www.americanoversight.org\/investigation\/trump-administrations-politicization-justice-department\"><span style=\"font-weight: 400;\">power<\/span><\/a><span style=\"font-weight: 400;\"> Trump has called for <\/span><a href=\"https:\/\/www.reuters.com\/world\/us\/donald-trump-wants-control-justice-department-fbi-his-allies-have-plan-2024-05-17\/\"><span style=\"font-weight: 400;\">many times<\/span><\/a><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Together with <\/span><a href=\"https:\/\/blog.ucsusa.org\/rachel-cleetus\/project-2025-would-be-disastrous-for-our-nation-and-our-climate\/\"><span style=\"font-weight: 400;\">disastrous environmental and climate rollbacks<\/span><\/a><span style=\"font-weight: 400;\"> that <\/span><a href=\"https:\/\/energyinnovation.org\/publication\/the-second-half-of-the-decisive-decade-potential-u-s-pathways-on-climate-jobs-and-health\/\"><span style=\"font-weight: 400;\">harm jobs and public health<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><b>a second Trump presidency could weaken democratic freedoms, justice, and public participation <\/b><span style=\"font-weight: 400;\">in ways that could exacerbate legal harassment in the public and private sector by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Centralizing power in the executive branch by making the Department of Justice an instrument for carrying out the presidential agenda<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Establishing presidential power to investigate and seek retribution from opponents, including journalists, activists, nonprofits, academics, and politicians<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Implementing <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/10\/26\/2020-23780\/creating-schedule-f-in-the-excepted-service\"><span style=\"font-weight: 400;\">Schedule F<\/span><\/a><span style=\"font-weight: 400;\"> to ensure government staff are loyal to the presidential agenda and can be reprimanded or replaced if they are not, even career civil servants and <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2020\/nov\/09\/mark-esper-fired-defence-pentagon-donald-trump\"><span style=\"font-weight: 400;\">high ranking officials<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/trump-wants-use-military-against-his-domestic-enemies-congress-must-act\"><span style=\"font-weight: 400;\">Deploying the military<\/span><\/a><span style=\"font-weight: 400;\"> against civilians and <\/span><a href=\"https:\/\/www.ifyoucankeepit.org\/p\/why-the-second-time-will-be-worse\"><span style=\"font-weight: 400;\">abusing the Insurrection Act against protestors<\/span><\/a><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Coordinating efforts to <\/span><a href=\"https:\/\/www.pbs.org\/newshour\/politics\/what-you-need-to-know-about-jeffrey-clarks-2020-election-charges\"><span style=\"font-weight: 400;\">overthrow<\/span><\/a><span style=\"font-weight: 400;\"> future democratic elections, including <\/span><a href=\"https:\/\/www.congress.gov\/116\/bills\/hres755\/BILLS-116hres755enr.pdf\"><span style=\"font-weight: 400;\">coercion of foreign governments<\/span><\/a><span style=\"font-weight: 400;\"> to interfere in elections and <\/span><a href=\"https:\/\/www.politico.com\/news\/2024\/03\/29\/trump-appoint-jeffrey-clark-doj-00149751\"><span style=\"font-weight: 400;\">using the Justice Department<\/span><\/a><span style=\"font-weight: 400;\"> to defend false claims of <\/span><a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/people-who-brought-you-project-2025-manufactured-evidence-voter-fraud\"><span style=\"font-weight: 400;\">voter fraud<\/span><\/a><span style=\"font-weight: 400;\"> or <\/span><a href=\"https:\/\/www.cnn.com\/2024\/09\/12\/politics\/trump-georgia-election-subversion-charges\/index.html\"><span style=\"font-weight: 400;\">election subversion<\/span><\/a><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Trump has denied involvement with Project 2025 despite sweeping support of <\/span><a href=\"https:\/\/www.cnn.com\/2024\/07\/11\/politics\/trump-allies-project-2025\/index.html\"><span style=\"font-weight: 400;\">many of his former advisors and staff<\/span><\/a><span style=\"font-weight: 400;\"> and evidence that <\/span><a href=\"https:\/\/climate-reporting.org\/undercover-in-project-2025\/\"><span style=\"font-weight: 400;\">he will support the Project\u2019s initiatives<\/span><\/a><span style=\"font-weight: 400;\">. Trump has supported a similar agenda called the America First Agenda (AFA) <\/span><a href=\"https:\/\/www.eenews.net\/articles\/inside-the-other-think-tank-orbiting-trump-world\/\"><span style=\"font-weight: 400;\">to publically distance himself<\/span><\/a><span style=\"font-weight: 400;\"> from the <\/span><a href=\"https:\/\/www.theatlantic.com\/politics\/archive\/2024\/08\/project-2025-backfired-trump\/679509\/\"><span style=\"font-weight: 400;\">disfavorable<\/span><\/a><span style=\"font-weight: 400;\"> Project 2025. The AFA comes from the <\/span><a href=\"https:\/\/newrepublic.com\/post\/185435\/donald-trump-far-right-group-america-first-transition-plan\"><span style=\"font-weight: 400;\">far-right American First Policy Institute<\/span><\/a><span style=\"font-weight: 400;\"> (AFPI) and was created by former senior advisors from the Trump administration.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">While the AFA is less prescriptive and detailed, it calls for many of the same changes as Project 2025, including stripping protections for the federal workforce and deregulation of the <\/span><a href=\"https:\/\/agenda.americafirstpolicy.com\/energy\"><span style=\"font-weight: 400;\">fossil fuel industry<\/span><\/a><span style=\"font-weight: 400;\">. The AFPI celebrated the <\/span><a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/trump-v-united-states-3\/\"><span style=\"font-weight: 400;\">SCOTUS ruling<\/span><\/a><span style=\"font-weight: 400;\"> on presidential immunity, stating that presidents should not have <\/span><a href=\"https:\/\/americafirstpolicy.com\/issues\/america-first-celebrates-supreme-court-decision-in-trump-v-u.s\"><span style=\"font-weight: 400;\">\u201cfear of being prosecuted in the future\u201d<\/span><\/a><span style=\"font-weight: 400;\">.
